NO THIRD-PARTY BENEFICIARIES; DISCLAIMER OF PARTNERSHIP <br /> LENDER/BORROWER RELATIONSHIP. Nothing contained in this Agreement is intended to <br /> or shall be deemed to confer upon any person, other than the Parties any rights or remedies <br /> hereunder. The relationship of the Parties under this Agreement is solely that of landlord and <br /> tenant, and it is expressly understood and agreed that the City does not as a result of this <br /> Agreement in any way nor for any purpose become a partner of the Lessee or a joint venturer <br /> with the Lessee in the conduct of business or otherwise by the Lessee. This Agreement is not <br /> intended to, and shall not be construed to, create the relationship of principal and agent, <br /> partnership,joint venture, or association as between the City and the Lessee. It is further <br /> expressly understood and agreed that this Agreement is not intended to, and shall not be <br /> construed to create the relationship of lender and borrower, and the City does not, solely as a <br /> result of this Agreement,become a lender to the Lessee. <br /> 24. ENTIRE AGREEMENT. This Agreement, together with Exhibits A through D <br /> which by this reference are hereby incorporated herein, contains the entire agreement between <br /> the Parties relative to the transactions covered hereby.
