The project shall comply with Exhibits A through D, attached to the staff report dated <br /> April 4, 2013, except as hereinafter modified. The applicant and property owner shall be responsible for assuring that any successor in <br /> interest who assumes responsibility for this zoning approval is informed of its terms and <br /> conditions. <br /> IL PERMITTED USES <br /> A. This Conditional Use Permit is an approval for a Liquor, Beer and Wine Store (Liquor <br /> Store) and Neighborhood Specialty Market use with a regionally-serving, specialty <br /> beverage and gourmet food store, Beverages and More, Inc. (BevMo!), at 15100 <br /> Hesperian Boulevard, Suite 400A; Alameda County Assessor's Parcel No. 77D-1490- <br /> 022-02. <br /> B. The Liquor Store may be open from 9 a.m. to 10 p.m. Sunday through Saturday. <br /> C. Alcoholic beverages tastings shall occur in a limited area as shown on Exhibit C (Floor <br /> Plans), not to exceed approximately 10-feet by 10-feet in area. <br /> D. Sales of cigarettes and malt liquors in 40 oz or greater containers shall be prohibited. <br /> All other types of alcoholic beverages may be sold provided that: (1) all fortified and <br /> specialty wines (defined as wine with 20% or greater alcohol content) shall be sold in <br /> cork-finished bottles unless they are sold from a display case kept locked and accessible <br /> only by licensee and its employees; and (2) no distilled spirits products shall be sold in <br /> containers greater than 50 milliliters and equal to or less than 375 milliliters unless <br /> they are sold from a display case kept locked and accessible only by licensee and its <br /> employees. <br /> E. Installation or use of video or pinball games, sales of pornographic videos and magazines, <br /> pay telephones, lottery tickets, newspaper stands, and other items that would encourage <br /> loitering or minors patronizing the store shall be prohibited. <br /> Agreement to Conditions April 4,2013 <br /> PLN2013-00003 Page 3 of 6 <br />
