Pursuant to Title 2, Chapter 2 -20 of the San Leandro Municipal Code and the California <br />Streets and Highways Code sections 36600 et seq, the City Council of the City of San <br />Leandro hereby approves the formation of the Downtown San Leandro Community <br />Benefit District (the "CBD "). <br />2. The boundaries of the CBD are set forth in the Downtown San Leandro Community <br />Benefit District 2013 Management District Plan (the '*Management Plan ") which is <br />attached hereto as Exhibit "A''. <br />3. The improvements and activities proposed for the CBD shall be funded by the levy of <br />assessments on the properties within the CBD boundaries. <br />4. The description of the proposed improvements and activities of the CBD are set forth in <br />the Management Plan and include, but are not limited to, the following special benefits: <br />a. Enhanced security, maintenance and beautification; <br />b. Promotion of CBD identity through District identity services and marketing; <br />C. Promotion of special enhanced residential services, including beautification and <br />public space development for blocks with high density residential developments; <br />and <br />d. Management of programs and operations. <br />5. The City Council authorizes the levy of assessments on properties located within the <br />Downtown CBD boundaries, in the amounts as shown in the District Assessment <br />Engineer's Report attached hereto as Exhibit "B ". <br />6. Except where funds are otherwise available, an assessment to pay for all specified <br />improvements and activities within the Downtown CBD will be levied annually. <br />7. After the Downtown CBD is formed, new property owners shall not be exempt from the <br />CBD assessment, but shall be assessed the appropriate amount in the prorated format <br />based upon the number of whole months remaining in the assessment period. <br />8. The properties in the Downtown CBD established by this CBD shall be subject to any <br />amendments of the Streets and Highways Code pertaining to the creation of property and <br />business improvement districts. <br />9. The levy and assessment that will fund improvements and activities within the CBD will <br />not be used to provide improvements or activities outside of the CBD or for any other <br />purpose other than the purposes specified in this Resolution of Formation and the <br />attachments hereto, as modified by the City Council at the public hearing concerning <br />establishment of the CBD. <br />RESOLUTION NO. 2013 -102 2 <br />
