EXHIBIT E <br /> GENERAL FEDERAL/STATE CONDITIONS <br /> COMMUNITY DEVELOPMENT BLOCK GRANT <br /> (Capital Improvement Projects) <br /> 1. GOVERNMENTAL REGULATIONS. To the extent that this Agreement may be funded <br /> by fiscal assistance from another governmental entity, Recipient shall comply with all <br /> applicable rules and regulations to which City is bound by the terms of such fiscal assistance <br /> program. In particular, Recipient agrees to comply with all applicable provisions of the <br /> Housing and Community Development Act of 1974 (Public Law 93-383) and regulations <br /> promulgated pursuant thereto. <br /> 2. RECORDS. Records must be kept accurate and up-to-date. Recipient's records shall be <br /> made available for review by the City, HUD or the designee. Recipient shall be responsible <br /> to maintain, for not less than three (3) years after completion of this Agreement, all records <br /> pertaining to this Agreement, including subcontracts and expenditures, and all other <br /> financial and property records. <br /> 3. AUDITS AND INSPECTIONS. <br /> A. Recipient shall at any time during normal business hours and as often as the City, <br /> HUD and the Comptroller General of the United States may deem necessary, make <br /> available to their representatives for examination all of Recipient's records with <br /> respect to all matters covered by this Agreement and shall permit these <br /> representatives to audit, examine and make excerpts or transcripts from such <br /> records, and to make audits of all documents and conditions relating to this <br /> Agreement. All costs are subject to the eligibility requirements of HUD. <br /> B. Recipient shall permit and facilitate observation and inspection of the work and <br /> records at Recipient's principal office and job site by City, its employees and public <br /> authorities during reasonable business hours. <br /> 4. CONFLICT OF INTEREST. <br /> A. Recipient certifies that no member of, or delegate to the Congress of the United <br /> States shall be permitted to share, or take part in this Agreement or in any benefit <br /> arising therefrom. <br /> B. Recipient certifies that no member, officer, or employee of the City of San <br /> Leandro, or its designees or agents, no member of the San Leandro City Council, <br /> and no other public official of the City of San Leandro who exercises any functions <br /> Exhibit E—DCARA page 1 of 10 <br /> July 15,2002 <br /> G:\Community Development\CDBG\DCARA\2002-03 <br />
