EXHIBIT E <br /> GENERAL FEDERAL/STATE CONDITIONS <br /> COMMUNITY DEVELOPMENT BLOCK GRANT <br /> (Service Agreement) <br /> 1. GOVERNMENTAL REGULATIONS. To the extent that this Agreement may be funded <br /> by fiscal assistance from another governmental entity, Consultant shall comply with all applicable <br /> rules and regulations to which City is bound by the terms of such fiscal assistance program. In <br /> particular, Consultant agrees to comply with all applicable provisions of the Housing and <br /> Community Development Act of 1974 (Public Law 93-383) and regulations promulgated pursuant <br /> thereto. <br /> 2. RECORDS. Records must be kept accurate and up-to-date. Consultant's records shall be <br /> made available for review by the City, HUD or their designee. Consultant shall be responsible to <br /> maintain, for not less than three(3) years after completion of this Agreement, all records pertaining <br /> to this Agreement, including subcontracts and expenditures, and all other financial and property <br /> records. <br /> 3. AUDITS AND INSPECTIONS. <br /> A. Consultant shall at any time during normal business hours and as often as the City, <br /> HUD and the Comptroller General of the United States may deem necessary, make available to <br /> their representatives for examination all of Consultant's records with respect to all matters covered <br /> by this Agreement and shall permit these representatives to audit, examine and make excerpts or <br /> transcripts from such records, and to make audits of all documents and conditions relating to this <br /> Agreement. All costs are subject to the eligibility requirements of HUD. <br /> B. Consultant shall permit and facilitate observation and inspection of the work and <br /> records at Consultant's principal office and job site by City, its employees and public authorities <br /> during reasonable business hours. <br /> 4. EQUAL EMPLOYMENT OPPORTUNITY. <br /> A. Affirmative Action in Employment <br /> 1. Consultant shall comply with the Affirmative Action Program and Equal <br /> Employment requirements of the City, State and Federal Government. <br /> 2. During the performance of this Agreement, Consultant agrees as follows: <br /> a. Consultant will not discriminate against any employee or applicant <br /> for employment because of race, color, religion, sex, sexual <br /> orientation, handicap, age, or national origin.
