The business shall participate in the Crime Free Business program offered by San Leandro Police Crime Prevention Bureau. 12. NON-TRANSFERABLE A. This permit is specific to A&A Bay Area Inc. Except as provided in Business and Professions Code section 23958.4, the public convenience or necessity determination is NOT transferable to another applicant or proposed licensee. Any new licensee for the same premises must submit a new application. IV. MAINTENANCE A. All exterior building surfaces shall be maintained in clean and orderly conditions. The site shall be kept free of litter, debris and weeds. B. Any graffiti shall be promptly removed from building walls and/or fences. The applicant • and any successors in interest shall comply with the rules and regulations of the City's graffiti removal program and shall grant a license and right of entry as requested to enforce the terms of such program. V. GENERAL REQUIREMENTS A. Any complaints regarding this business may be grounds for a review hearing by an Administrative Hearing Board or revocation of the Determination of Public Convenience or Necessity by the either the Community Development Director or Chief of Police. B. The approvals granted by the City as a result of this application, as well as the Conditions of Approval, shall be recorded in the office of the County Recorder of Alameda County. C. No application for amendment of the Conditions of Approval may be submitted or accepted for processing by the City unless (i) there is full compliance with all terms of the application and Conditions of Approval; or (ii) the Community Development Director and Chief of Police waives compliance with the terms of the application and Conditions of Approval pending application for amendment. D. Pursuant to Zoning Code Section 5-2218, this approval shall lapse on July 31, 2014 unless a) a business license has been issued, coupled with diligent progress evidencing a good faith intent to commence the intended use, or b) a written request for a one-year extension of the use permit is approved by the, Community Development Director and Chief of Police and there are no outstanding enforcement complaints.
