• <br /> 8. A surveillance camera is required at the register and another in the parking lot. <br /> • <br /> 9. The parking lot shall be adequately lit during darkness when business is open. <br /> 10. Mandatory ID check is required for anyone under the age of 35, and use of a <br /> device that checks the age of those that purchase alcohol. <br /> 11. The business shall participate in the Crime Free Business program offered by <br /> San Leandro Police Crime Prevention Bureau. <br /> 12. The applicant must attend owner LEAD training and all cashiers shall attend <br /> server training. Information regarding training programs is available at: <br /> www.abc.ca.gov/programs/lead training <br /> III. NON-TRANSFERABLE <br /> A. This permit is specific to A&A Bay Area Inc. Except as provided in Business and <br /> Professions Code section 23958.4, the public convenience or necessity determination is <br /> NOT transferable to another applicant or proposed licensee. Any new licensee for the <br /> same premises must submit a new application. <br /> IV. MAINTENANCE <br /> A. All exterior building surfaces shall be maintained in clean and orderly conditions. The <br /> site shall be kept free of litter, debris and weeds. <br /> B. Any graffiti shall be promptly removed from building walls and/or fences. The applicant <br />• <br /> and any successors in interest shall comply with the rules and regulations of the City's <br /> graffiti removal program and shall grant a license and right of entry as requested to <br /> enforce the terms of such program. <br /> V. GENERAL REQUIREMENTS <br /> A. Any complaints regarding this business may be grounds for a review hearing by an <br /> Administrative Hearing Board or revocation of the Determination of Public Convenience or <br /> Necessity by the either the Community Development Director or Chief of Police. <br /> B. The approvals granted by the City as a result of this application, as well as the Conditions of <br /> Approval, shall be recorded in the office of the County Recorder of Alameda County. <br /> C. No application for amendment of the Conditions of Approval may be submitted or accepted <br /> for processing by the City unless (i) there is full compliance with all terms of the application <br /> and Conditions of Approval; or (ii) the Community Development Director and Chief of <br /> Police waives compliance with the terms of the application and Conditions of Approval <br /> pending application for amendment. <br /> D. Pursuant to Zoning Code Section 5-2218, this approval shall lapse on July 31, 2014 unless <br /> a) a business license has been issued, coupled with diligent progress evidencing a good faith <br /> intent to commence the intended use, or b) a written request for a one-year extension of the <br /> use permit is approved by the, Community Development Director and Chief of Police and <br /> there are no outstanding enforcement complaints. <br /> PLN2013-00021 Agreement to Conditions <br /> August 6, 2013 Page 4 of 4 <br />
