Any person who desires to have recorded a notice rescinding the notice of violation must <br />first obtain the necessary approvals and permit(s) to correct the violation. Once the <br />Building Official determines that the work covered by such permit(s) has been <br />satisfactorily completed, the Building Official may record a notice rescinding the prior <br />notice of violation. <br /> <br />Following the recordation of the notice of violation the Building Official is not required to <br />make any inspection or review of the premises to determine the continued existence of <br />the cited violation. It is the responsibility of the property owner, occupant or other similarly <br />interested private party to comply with the above provisions. <br /> <br />114.10 Costs. <br />Any person that violates any provision of this Code shall be responsible for the costs of <br />any and all Building Code enforcement actions taken by the Building Official in response <br />to such violations. These costs shall be based on the amounts specified in the San <br />Leandro Administrative Code, Title 6 Chapter 4, including but not limited to any attorneys’ <br />fees and costs. <br /> <br />SECTION 115 <br />STOP WORK ORDER <br /> <br />115.1 Authority. <br /> <br />Whenever the Building Official finds any work regulated by this Code being performed in <br />a manner either contrary to the provisions of this Code or dangerous or unsafe, the <br />Building Official is authorized to issue a stop work order. <br /> <br />115.2 Issuance. <br /> <br />The stop work order shall be in writing and shall be given to the owner of the property <br />involved, or to the owner’s agent, or to the person doing the work. Upon issuance of a <br />stop work order, the cited work shall immediately cease. The stop work order shall state <br />the reason for the order, and the conditions under which the cited work will be permitted <br />to resume. <br /> <br />115.3 Unlawful continuance. <br /> <br />Any person who shall continue any work after having been served with a stop work order, <br />except such work as that person is directed to perform to remove a violation or unsafe <br />condition, shall be subject to penalties as prescribed by law. <br /> <br />SECTION 116 <br />UNSAFE BUILDINGS, STRUCTURES, EQUIPMENT AND UNOCCUPIED BUILDINGS <br /> <br />116.1 Scope. <br />
