<br />116.3.5 Declaration of an unsafe building. <br /> <br />Whenever the Building Official determines by inspection that a building or structure, <br />whether structurally damaged or not, is dangerous to human life by reason of being <br />located in an area which is unsafe due to hazard from landslide, settlement, or slippage or <br />any other cause, such building shall, for the purpose of this Chapter, be considered an <br />unsafe building. <br /> <br />No person shall own, use, occupy or maintain any unsafe building. <br /> <br />All unsafe buildings are hereby declared to be public nuisances. In addition to instituting <br />any appropriate action to prevent, restrain or correct a violation of this section, the <br />Building Official may abate an unsafe condition by repair, rehabilitation, demolition or <br />removal in accordance with the procedure specified in this chapter. <br /> <br />116.4 Notice of Unsafe Building. <br /> <br />The Building Official may examine or cause to be examined any building or structure or <br />portion thereof reported as dangerous or damaged and if, in the Building Official's <br />opinion, such is found to be an unsafe building as defined in this Chapter, the Building <br />Official shall give to the property owner written notice stating the defects thereof. This <br />notice may require the owner or person in charge of the building or premises to <br />immediately commence either the required repairs or improvements or demolition and <br />removal of the building or structure or portions thereof and all such work shall be <br />completed within a specified time or date stipulated by the Building Official. If necessary, <br />such notice shall also require the building, structure, or portion thereof to be vacated <br />forthwith and not reoccupied until the required repairs and improvements be completed, <br />inspected and approved by the Building Official. <br /> <br />The Building Official shall serve or cause to be served either in the manner required by <br />law for the service of summons or by first class mail, postage prepaid or by posting a <br />copy, the notice of hearing upon the property owner. <br /> <br />In the event the Building Official, after reasonable effort, is unable to serve the notice as <br />specified above, proper service shall be by posting on the structure a copy of the notice. <br /> <br />The designated period within which the owner or person in charge is required to comply <br />with such notice shall begin as of the date the owner or person in charge receives such <br />notice by personal service or registered or certified mail. If such notice is by posting, the <br />designated period shall begin ten days following the date of posting. <br /> <br />The failure of any owner or other person to receive such notice shall not affect in any <br />manner the validity of any proceedings taken hereunder. <br /> <br />A person notified to vacate an unsafe building by the Building Official shall vacate within
