Ordinance No. 95-08, An Ordinance of the City Council of the City of <br /> San Leandro Adding Chapter 11 to Title I of the San Leandro Municipal <br /> Code Relating to the Consolidation of the General Municipal Election <br /> with the Statewide Election and Providing the Date for Commencement of <br /> Terms of Office (changes date of General Municipal Election to the <br /> fourth Tuesday in March in even-numbered years, to provide for <br /> consolidation with the State-wide Primary Election) . (1055) <br /> Introduced by Council Member Kerr, who moved that it be passed to <br /> print, as amended, seconded by Council Member Polvorosa, and carried by <br /> a majority vote (7) . <br /> U. Matter of Approval of Findings of Fact and Conditions of Approval <br /> Regarding City Council 's Approval of Variance, V-94-5, 14289 Santiago <br /> Road, R. Shih. <br /> It was moved by Council Member Galvan, seconded by Council Member Kerr, <br /> to approve the findings of fact. <br /> Council Member Polvorosa said he wished to add a Condition that, if the <br /> footings must be removed in order to comply with the Building Code, the <br /> Applicant must build back to the 10' setback and meet the requirements <br /> of the current Zoning Code. <br /> Planning Manager Steve Emslie repeated that the Council wanted to add <br /> a Condition that, if the foundation and rear wall are required to be <br /> removed to comply with Building Standards, then the variance would not <br /> apply, and the structure would have to be brought into compliance with <br /> the full 10' setback, as opposed to the 5' setback. <br /> The City Attorney said the effect of the Condition proposed would be <br /> that, if she could not comply with that requirement, the variance would <br /> effectively be removed, and that would require her to either take down <br /> the structure or come back before the Board of Zoning Adjustments for <br /> another variance. <br /> Council Members Galvan and Kerr concurred with the addition to the <br /> motion. <br /> The following Motion was then introduced: <br />
