Minutes - San Leandro City Council Meeting - June 19, 1995 Page - 10 - <br /> PUBLIC HEARINGS (continued) <br /> Yvette Buhler, 13160 Neptune Drive, expressed confusion regarding the <br /> zoning. She said the property has 25 feet less width than is required; <br /> and it was her understanding that, under the old code, they still have <br /> less than is needed-for• a duplexT—She 'said-the proposal looks like an <br /> apartment building. She said she has three units, each a three-bedroom <br /> house with double-car garages. She said this project belongs on Marina <br /> Boulevard, not on Neptune Drive. She said it is not conducive to the <br /> street and is too massive. <br /> Larry Norry, President of Mulford Gardens Homeowners' Association, said <br /> 23 residents opposed the project. He said the majority of the people <br /> on Neptune Drive- -are against- the project, as is the homeowners' , <br /> association. He said he did not see how staff could recommend approval <br /> in light of the BZA denial and opposition. He said the lot is 71 .4 <br /> feet in width, which is insufficient under all zoning types. He said <br /> he would not object to two, single-family homes. He believes the <br /> property was improperly zoned. He said many of the people in favor of <br /> the project don't live on Neptune Drive. He said the City Council <br /> should not approve the project because it is on a substandard lot. <br /> Council Member Galvan referred to Mr. Norry's petition opposing the <br /> project; he said it stated that RM 1800 zoning is illegal and said this <br /> is not true. He said the Applicants could build a 50-foot tall <br /> structure with no Conditions and asked if that would be okay with Mr. <br /> Norry. Mr. Norry said he did not agree that could happen. Council <br /> Member Gal van read proposed Conditions of Approval for the project. He <br /> said a single-family home could be built with no Conditions or control <br /> over aesthetics. <br /> Council Member Myers said the BZA Minutes indicate Mr. Norry agreed to <br /> a single-family home and a duplex in the back. Mr. Norry said what he <br /> agreed to was within the Zoning Code, and no Variances or Conditions <br /> were needed. Council Member Myers said this proposal has the same <br /> amount of square footage as a single-family home and a duplex and has <br /> more open space than the property next door. <br /> Joel Hart, 13125 Neptune Drive, said the lot is substandard under RM <br /> 1800 zoning. He said there was no notification that RM 1800 zoning was <br /> implemented. He said the drawing is nice, but the structure looks like <br /> a motel . He said Neptune Drive should not be zoned RM 1800 like Marina <br /> Boulevard. He said the lot is only 71 .49 feet wide. He said Marina <br /> Boulevard is the gateway to the Marina and more rental units are not <br /> needed. The majority of the property owners on Neptune Drive oppose <br /> the project. It is a nice design but is too large and not consistent <br /> with the area. <br /> Audrey Albers, 2037 Marina Court, said she does not object to a duplex <br /> if the lot is big enough, but it is not. RM 1800 zoning is ridiculous <br /> for the area; this lot was 0 PDC. She said she is in favor of <br /> development, but this violates RM 1800 and is the wrong development, <br /> wrong for the community and the neighbors, the Marina, and the entire <br /> City. <br /> • <br />
