Minute Order No. 95-63, Matter of Appointment of Council Members <br /> Loeffler and Polvorosa to the City Council 's Finance Committee. (1156) <br /> On motion by Council Member Myers, who moved its approval , seconded by <br /> Council Member Kerr, and carried by a majority vote (7) , the City <br /> Council appointed Mayor Corbett and Council Members Loeffler and <br /> Polvorosa to the City Council Finance Committee. <br /> K. Matter of Proposal from Livermore-Amador Valley Water Management Agency <br /> (LAVWMA) for Expanded Use of East Bay Dischargers Wastewater Outfall . <br /> Bob Taylor, Public Works Services Director, described the membership of <br /> the East Bay Dischargers Authority (EBDA) and Livermore-Amador Valley <br /> Water Management Agency (LAVWMA) . He said several years of discussion <br /> have taken place between the two agencies regarding LAVWMA's use of <br /> EBDA's deepwater outfall for purposes of growth in the Valley. He said <br /> LAVWMA participated in the_construction of the outfall .._ They did not <br /> become members, but they purchased 19 million gallons per day (mgd) of <br /> capacity in the outfall . They have looked at several alternatives <br /> given their need for expansion, and the most favored has to do with <br /> bringing treated wastewater from LAVWMA to EBDA. He said LAVWMA is <br /> asking for 11 .42 mgd peak dry weather flow. EBDA made a formal offer <br /> to lease the capacity to LAVWMA, providing for a $10 million capital <br /> buy-in payable to the EBDA members. LAVWMA developed a counter <br /> proposal which changed the interest rate, when interest payments would <br /> start, and the number of years over which the payments would be spread. <br /> Mr. Taylor described the cost benefits and savings to San Leandro. He <br /> said, after negotiations, the negotiating committee settled on 3% <br /> interest rate, with an agreement term to 2030, and also determined how <br /> much of the Operations and Maintenance costs would be picked up by <br /> LAVWMA. He said a formal proposal was made from LAVWMA to EBDA in late <br /> June which stated that LAVWMA had a continuing interest in purchasing <br /> non-interruptible capacity from the member agencies of EBDA. LAVWMA <br /> originally had proposed a condition that an EBDA member agencies agree <br /> to a veto-proof option for them to purchase capacity from any member <br /> agency; however, this was not included in the current formal proposal <br /> but was included in LAVWMA's letter.
