He said the <br /> City should not decide if the Valley should grow, but he wants to be in <br /> a position to obtain revenue if it does grow. He said Dublin-San Ramon <br /> is not at the table because of the growth issue, but they constitute <br /> 30% of the growth. He said San Leandro should fight for its right to <br /> sell excess capacity in the future without threat of veto and should <br /> ask for more discussion on the influent/effluent issue. He said part <br /> of Dublin-San Ramon's vote was in solidarity with San Leandro. <br /> Council Member Loeffler asked for clarification on the recommendation <br /> to protect the City's interest. The City Attorney said an abstention <br /> would count as a No vote under the JPA. Council Member Loeffler said <br /> the Council is in agreement on protecting San Leandro's capacity. He <br /> said he believes LAVWMA will come back to the table to obtain access to <br /> the capacity. <br /> It was moved by Council Member Myers to direct the City's <br /> Representative and Alternate to the East Bay Discharger's Authority <br /> (EBDA) to vote "NO" on the current Livermore-Amador Valley Water <br /> Management Agency (LAVWMA) proposal and instruct the San Leandro <br /> Representative and Alternate to urge EBDA to continue negotiations and <br /> work toward resolution of outstanding issues, such as active <br /> participation of Dublin-San Ramon Services District in the LAVWMA <br /> proposal and resolution regarding EBDA's member agencies' ability to <br /> sell excess capacity to LAVWMA. <br /> Council Member Perry requested that the motion include regular periodic <br /> reports on the matter. She said she is comfortable with the issue of <br /> selling the City's capacity, but she is not comfortable with dictating <br /> growth management until she has more information as to the reasons from <br /> the other agencies. <br /> Council Member Galvan said he did not recommend deleting language <br /> related to growth control but felt additional discussion and <br /> negotiation were needed to get Dublin-San Ramon back to the table. <br /> Council Member Perry said she would like to see all the unresolved <br /> issues come back. <br /> Council Member Myers clarified that his motion was to vote No but keep <br /> the negotiations open. He amended his motion to require periodic <br /> reports. <br /> In response to a question by Mayor Corbett, Council Member Galvan said <br /> Hayward requested the urban limit line and the issue of influent/ <br /> effluent measurement. He said it is an EBDA member issue, not a LAVWMA <br /> issue. <br /> The motion was seconded by Vice Mayor Kerr. <br /> Council Member Myers repeated the motion. <br />
