Resolution of Award of Contract to T & L Landscaping for North/South/West <br /> Dike Road Median Landscaping, Project No. 95-597-8670 (recommends award to <br /> the low bidder for bid amount of $104,611 .25) . <br /> Bob Rockett, City Engineer, said the second bidder was protesting the <br /> award. Mr. Rockett said T & L Landscaping's bid contained numerous minor <br /> inaccuracies, but staff could determine exactly what the contract meant by <br /> the information that was provided. He said T & L wanted to rescind their <br /> bid because they had bid too low on one item. However, State law does not <br /> permit withdrawal of a bid for this reason; therefore, staff recommended <br /> award. In response to Council questions, Mr. Rockett said the bid could <br /> only be withdrawn if an error had been made. He said if T & L refuses to <br /> sign the contract, their bid bond will be forfeited. <br /> The following Resolution was then introduced: <br /> Resolution No. 95-163, Resolution of Award of Contract to I & L Landscaping <br /> for North/South/West Dike Road Median Landscaping, Project No. 95-597-8670 <br /> (recommends award to the low bidder for bid amount of $104,611 .25) . (2791) <br /> Introduced by Council Member Myers, who moved its adoption, seconded by <br /> Council Member Loeffler, and carried by a majority vote (7) . <br /> A. Resolution Adopting Space Rent Agreement By and Between Brandenburg- <br /> Staedler Mission Bay Mobilehome Community, the City of San Leandro, and <br /> the Tenants of Mission Bay Mobilehome Community (adopts new five-year <br /> Lease, commencing December 1, 1995) . <br /> Vice Mayor Kerr said the tenants' committee worked very hard getting <br /> the information out and responding to suggestions. He said they had at <br /> least 17 meetings, and the park owners held meetings with anyone who <br /> wanted explanations. He said they did an excellent job in developing <br /> an agreement that the City Council subcommittee thinks is reasonable. <br /> He said the City Council does not negotiate the terms of the agreement <br /> but assists with the preparation. The role of the City is to ensure <br /> that the agreement in its entirety is reasonable and the tenants or <br /> majority of tenants understand it. Also, the agreement provides that <br /> the City mediate disputes over the terms during the life of the <br /> agreement and agrees to suspend consideration of a rent control <br /> ordinance and, if it does impose one, it would not apply to Mission Bay <br /> until expiration of the agreement. He said 78% of the tenants approved <br /> the agreement, and he said the Council committee, consisting of himself <br /> and Council Members Galvan and Polvorosa, recommended approval by the <br /> City Council . <br />
