She said <br /> the six development nodes are in areas found to be blighted. She discussed <br /> rent differentials loss-of-goodwill payments. <br /> In response to questions by Vice Mayor Kerr, Ms. Potter explained <br /> implementation of eminent domain requires a public hearing each time it is <br /> used. If additional properties are added to eminent domain, all property <br /> owners in the entire Joint Project Area will be notified of the public <br /> • hearing. The number of properties to be obtained in the next 10 years <br /> depends on what property owners or developers in the private sector <br /> suggest, but the process provides the greatest flexibility. June Catalano <br /> said it is hoped the process will encourage the sale of vacant properties <br />• as a result of the extension of capital gains payment. Ms. Potter said <br /> only_a handful of properties in the unincorporated portion of the Project <br /> Area are subject to eminent domain. She discussed the impact eminent <br /> domain would have on the Pacific High School Athletic Fields and said there <br /> have been no comments from the School District. <br /> In response to questions by Council Member Perry, Ms. Potter said there is <br /> a 9-1/2 year sunset on eminent domain in the Joint Project Area, unless it <br /> is extended through a major Plan Amendment. She discussed the types of <br /> relocation assistance available, including loss-of-goodwill payments, rent <br /> differentials, payment for moving equipment, printing new stationery, etc. <br /> She described how fair market value is determined. <br /> In response to questions by Council Member Galvan, Ms. Potter said <br />• relocation costs are determined by the State Uniform Relocation Act, and <br /> the Redevelopment Agency has guidelines, and a relocation plan must be <br /> approved. She said property owners have input as to the value of the <br /> property and contents and then review and approve appraisals. She said <br /> payment is made for loss of revenue while property owners relocate, and a <br /> consultant helps them find a new site. <br /> In response to questions by Mayor Corbett, Ms. Potter said the City may <br /> help pay for cleanup. State law provides that, if the Agency is involved <br /> in cleanup, immunity is granted from future liability. She described how <br /> property owners are assured they receive the highest value for their <br /> property and said the Agency pays all closing costs, there are no broker's <br /> fees, and it is a cash sale. She said property owners are still <br /> responsible for paying capital gains taxes. Ms. Potter said staff met with <br /> the owner of the Doral property, who wants to remain neutral . <br /> The Hearing was then opened to the public. <br />
