Kauffman, Jr. , 2493 Bermuda Avenue, San Leandro, <br /> November 12, 1992. <br /> - Gerald Dorn, 293 Elsie Avenue, San Leandro, November 13, <br /> 1992. <br /> The City Clerk noted a letter supporting the Appeal had also been <br /> received from Alice Moller, 2271 West Avenue 135th, San Leandro. <br /> This being the time and place for the Public Hearing on the above <br /> matter, Elmer Penaranda, Associate Planner, said the subject property <br /> is located on the north side of 133rd Avenue between Doolittle and <br /> Aurora. He said it is developed with a single-family home in front and <br /> a two-story, two-unit duplex in the rear, as well as a carport, paving <br /> for a driveway, and landscaping. He said the Applicant proposes to re- <br /> zone the property to 0-PDC to allow for individual sale of the three <br /> units. He said the 0 zone allows for a single-family home and two <br /> units. The Planning Commission and staff favor approving the re-zoning <br /> and the Planned Development because it will allow all three units to be <br /> owner occupied, will impose Conditions, and will protect the property <br /> from any other variations. He said the PDC requires Planning <br /> Commission and City Council approval . He said at the Planning <br /> Commission Hearing there was a general consensus that condominiums will <br /> typically be owner occupied, better maintained, and may provide <br /> affordable housing. He said those in opposition to the re-zone said <br /> that owner occupancy does not ensure upkeep of properties. He said the <br /> Mulford Gardens Improvement Association is opposed to spot zoning in <br /> the Mulford area. <br /> Mr. Penaranda described the Conditions that would be imposed, including <br /> a requirement for a Parcel Map, improvements to paving on the site, and <br /> replacement and/or modification to the mail box and fence. He <br /> submitted photographs of the existing site. He said staff and the <br /> Planning Commission recommend approval with Conditions. <br /> Council Member Myers asked, if a fire destroyed the property, could the <br /> buildings be rebuilt as three separate units. Mr. Penaranda said they <br /> could, as long as they were built in conformance with the Planned <br /> Development. <br />
