Minutes - San Leandro City Council Meeting - January 4, 1993 Page - 8 -
NEW BUSINESS (continued)
Council Member Myers asked if, in this case, the City would be the
person the property owner would contact. Mr. McCammon said the City
would expect the person who had the contamination to determine its
extent and noted that he has been working with Mayor Karp at the State
level to see if there is something that can be done about third-party
liability. He said this is a State-wide issue that the regulatory
community is trying to deal with.
Mayor Karp said he is trying to get the State to pass a law to take
care of the third-party situation.
Mr. Filipovich said he would like to talk about hazardous liability and
the third-party lawsuit.
Mayor Karp said he would be given a chance after the present speaker
was finished.
Council Member Kerr asked what the relationship was now between the
County, the City, and the State and how far the City goes in various
situations.
Mr. Bakaldin said the City has given the County a list of sites,
including all of the major oil companies . He said a case like this
would end up with the County. He said, in general , there will be no
relationship between the County and the City except for the City's
authority to oversee the County and make sure they are meeting the
requirements of their contract. He said the State is really the final
authority on everything, and the City is trying to set the pace and
assist the public.
Council Member Kerr said he wants to make sure duplication is avoided.
Mr. Bakaldin said if the County has a case and the City has another
similar case, they would work together to make sure there was
consistency.
Council Member Corbett asked if the State and the County had some sort
of funding for this program and if the City could make use of any of
that funding.
Mr. McCammon said the State and County are funded but at a very low
level and are unable to do very much. He said the Regional Board only
pursues large projects where they can go to court and have a
possibility of winning. He said it is the City's intention to help
property owners through the system. He said the City will bill to
recover costs. He said Alameda County and the State also recover costs
from property owners, but the City's charges will be half the cost of
the County or State.
