Mr. McCammon said the City <br /> would expect the person who had the contamination to determine its <br /> extent and noted that he has been working with Mayor Karp at the State <br /> level to see if there is something that can be done about third-party <br /> liability. He said this is a State-wide issue that the regulatory <br /> community is trying to deal with. <br /> Mayor Karp said he is trying to get the State to pass a law to take <br /> care of the third-party situation. <br /> Mr. Filipovich said he would like to talk about hazardous liability and <br /> the third-party lawsuit. <br /> Mayor Karp said he would be given a chance after the present speaker <br /> was finished. <br /> Council Member Kerr asked what the relationship was now between the <br /> County, the City, and the State and how far the City goes in various <br /> situations. <br /> Mr. Bakaldin said the City has given the County a list of sites, <br /> including all of the major oil companies . He said a case like this <br /> would end up with the County. He said, in general , there will be no <br /> relationship between the County and the City except for the City's <br /> authority to oversee the County and make sure they are meeting the <br /> requirements of their contract. He said the State is really the final <br /> authority on everything, and the City is trying to set the pace and <br /> assist the public. <br /> Council Member Kerr said he wants to make sure duplication is avoided. <br /> Mr. Bakaldin said if the County has a case and the City has another <br /> similar case, they would work together to make sure there was <br /> consistency. <br /> Council Member Corbett asked if the State and the County had some sort <br /> of funding for this program and if the City could make use of any of <br /> that funding. <br /> Mr. McCammon said the State and County are funded but at a very low <br /> level and are unable to do very much. He said the Regional Board only <br /> pursues large projects where they can go to court and have a <br /> possibility of winning. He said it is the City's intention to help <br /> property owners through the system. He said the City will bill to <br /> recover costs. He said Alameda County and the State also recover costs <br /> from property owners, but the City's charges will be half the cost of <br /> the County or State. <br />
