Minutes - San Leandro City Council Meeting - January 11 , 1993 Page - 7 - <br /> NEW BUSINESS (continued) <br /> Paul Merrick, 3058 Revere Avenue, Oakland, representing Sheffield <br /> Village Homeowners Association and the Dunsmuir Ridge Alliance, said he <br /> did not have enough time to put together a 10-minute presentation. He <br /> said Dunsmuir Heights would have a disastrous effect on his <br /> neighborhood. He said the Oakland General Plan is outdated and not in <br /> compliance with State law. He said Oakland is not in a position to <br /> legally approve the project. He said the best defense is to tell <br /> Oakland that San Leandro fully expects them to meet the same standards <br /> as San Leandro. He said Oakland is concerned that San Leandro is <br /> prepared to challenge the project and the Hayward Exchange is concerned <br /> about this. He said the Hayward Exchange has not offered to scale the <br /> project back, to find better circulation patterns, or to develop <br /> alternate access to protect the visual face of the ridge. He said they <br /> are offering a payoff that sells off the quality of life in San <br /> Leandro. He said this will be a betrayal and breach of public trust. <br /> He said he did not agree with the argument that the City Council could <br /> take the cash and still oppose the project. He said, once they take <br /> the cash, they will have no impact. He said, if the project is <br /> approved by Oakland, the developer would still negotiate with San <br /> Leandro. He said the most important function of government is to <br /> protect its citizens and asked the City Council not to sell them out at <br /> any price. <br /> Susan Goodman, 498 Superior Avenue, President of Broadmoor Homeowners <br /> Association, said it was difficult to put anything together on such <br /> short notice. She said they are outraged at this proposal . She said <br /> the MOU says "if" a lot, and this should make the City Council <br /> suspicious. She said important decisions are being made based upon <br /> incomplete information. She asked the City Council to listen and <br /> represent the people. She said there still is not a complete <br /> description of the project, and there are questions regarding traffic, <br /> mutual aid, etc. She said these are strong-arm tactics by the Hayward <br /> Exchange, and it has not had to adhere to the usual process. She said <br /> Hayward Exchange wants to be able to go to Oakland on Thursday and say <br /> they have cleared up loose ends. She said the Hayward Exchange never <br /> intended to attend to San Leandro. She said the dollars and the logic <br /> don't add up, and this is not in our best interests. She asked the <br /> City Council to tell the Hayward Exchange the offer is not acceptable. <br /> She said it is inappropriate for San Leandro to take action now, and it <br /> would cost less to undertake litigation. <br /> Toni Reynolds, 880 St. Mary Avenue, quoted a September 17th memo to the <br /> City Council regarding meeting with the Hayward Exchange, which said <br /> the developer is proposing to negotiate with San Leandro following <br /> action by the Oakland City Council . She said, if the Appeal is <br /> successful , San Leandro can still obtain mitigation, and asked why the <br /> City Council was doing this now. She said the traffic study is <br /> outdated, and traffic patterns have changed since the Loma Prieta <br />
