He <br /> said, under the I-G zone, they could get a Conditional Use and <br /> establish Conditions to be a permitted use. He said, if the City <br /> Council approves the I-2 zoning tonight, the use would be permitted; <br /> but, if it were re-zoned to I-G, it would become a legal , non- <br /> conforming use. <br /> Council Member Perry asked questions regarding the setback and <br /> landscaping requirements on I-G. Mr. Weisbrod said there is a 10-foot <br /> setback requirement, and 5% of the total site must be devoted to <br /> landscaping. <br /> Council Member Myers asked, if this property were re-zoned to I-2, <br /> would everything except Reynolds and Brown then be I-2, and then be <br /> considered I-G under the new Zoning Code. Steve Emslie said there is <br /> no one-for-one transfer in the new Zoning Code, so these would be I-G. <br /> He said, if the City Council changed the zoning to I-2, staff would <br /> apply I-G in the future. He said if the trucking firm increased in <br /> size it would be a modification to its Conditional Use and would have <br /> to come back to the BZA. <br /> Council Member Perry said she is concerned about being consistent in <br /> whatever zone is selected so that everything becomes I-G in the new <br /> Zoning Code. <br /> Council Member Corbett asked if Best could expand their use if their <br /> property were re-zoned right now. Mr. Emslie said Best-Ruan is not <br /> legal under the existing zoning, so they would need a Use Permit under <br /> the I-G zoning. Steve Meyers said properties that were zoned I-2 <br /> tonight would have all the rights of I-2 until the I-G Map is adopted. <br /> He said once a property becomes I-G, they would be allowed to operate <br /> at whatever legal standards they were operating under when they became <br /> I-G. They would then need a Conditional Use for any activities which <br /> exceeded those standards. Mr. Weisbrod noted, if the City Council <br /> approved the I-2 zoning tonight, it would be at least six weeks before <br /> it would become effective. <br /> In response to a question from Council Member Kerr, Norm Weisbrod said <br /> there would still be two small I-P zones within the area. <br /> Council Member Corbett asked for an explanation of the difference <br /> between I-G, I-P, and I-2. Steve Emslie said the I-G zoning would not <br /> apply until the Zoning Map is considered. He said it is somewhat more <br /> restrictive than the I-2 zone is now. He said it requires a <br /> Conditional Use for trucking facilities. He said manufacturing uses <br /> are permitted under all the zones. He said I-2 has the most setbacks; <br /> I-G has a 10-foot front yard setback. He said parking is relatively <br /> the same. He said under I-G staff review of design standards is <br /> required. <br />
