Minutes - San Leandro City Council Meeting - March 1, 1993 Page - 13 - <br /> PUBLIC HEARINGS (continued) <br /> Steve Emslie, Planning Manager, said this matter was coordinated with <br /> the Fire Department, and all that was before the City Council was the <br /> concept. He said staff was asking for direction to prepare a specific <br /> ordinance to allow staff to review toxic remediation programs for <br /> aesthetic screening requirements. He said right now no screening is <br /> authorized, and people only have to meet Fire Department technical <br /> rules. He cited as an example the gas station on MacArthur Boulevard, <br /> which has taken two years to complete. He said staff is looking for <br /> flexibility to impose conditions. <br /> Council Member Corbett asked if the City has guidance from other <br /> jurisdictions as to how they deal with these matters. Mr. Emslie said <br /> he was not aware of other jurisdictions who had this requirement. <br /> Council Member Corbett said, as far as the idea of shielding the public <br /> from the noise and aesthetic problems, she thinks it's a good idea. <br /> Council Member Corbett said any requirements need to be flexible and <br /> not overly costly for a person who has already been burdened by <br /> remediation costs. <br /> Council Member Perry said she was concerned that noise impacts are the <br /> crux of the matter and cited the 139th Avenue remediation as a problem. <br /> Council Member Kerr said he felt this was an excellent start and a good <br /> program because it would give authority to staff to do the decision <br /> making. He said he feels too many matters go before the Board of <br /> Zoning Adjustments and Planning Commission that could be processed by <br /> staff. <br /> Council Member Myers asked if that was what staff was asking for - <br /> direction as to whether these issues should go to staff or to the <br /> Commission. Staff said this was correct. <br /> Mr. Mattas said the Planning Commission recommendation was to have <br /> staff make the initial determination and then the applicant could <br /> appeal to the Site Development Subcommittee or staff could take the <br /> matter to the Subcommittee if they felt it was complex. <br /> Council Member Faria said he prefers that the procedure remain as it is <br /> now where the Site Development Subcommittee reviews applications or <br /> issues informally and then has a formal hearing if necessary. <br /> Mr. Emslie reiterated that staff recommended that the Code be amended <br /> to require the Site Development Subcommittee to review, but the <br /> Planning Commission wanted staff review because they did not want to <br /> overburden the Site Development Subcommittee. <br /> Council Member Faria and Mayor Karp said they prefer to have the Site <br /> Development Subcommittee review these matters. <br /> Council Member Faria said he thinks the public has a problem with just <br /> having staff review applications and feels the Subcommittee members can <br /> be more objective. <br />
