It was indicated that the process is <br /> informal and the Subcommittee meets formally perhaps four times a year. <br /> Mr. Emslie said review by the Site Development Subcommittee would not <br /> add additional time to the process. <br /> Council Member Perry said she was concerned about how the City would <br /> interface with other agencies in mitigation of toxics. <br /> The Hearing was then opened to the public. <br /> Lou Filipovich, 15376 Laverne Drive, asked, who makes the decision if <br /> toxic clean-up is warranted, the City, the County, or the State? Staff <br /> said it would be all three, plus the Federal Government, depending upon <br /> the situation; and the City would not have precedent over the other <br /> agencies. Mr. Filipovich asked if residential property would be <br /> exempt. Staff responded it would not. Mr. Filipovich said this did <br /> not protect the average homeowner. Steve Mattas said an initial <br /> determination regarding the need to mitigate toxics on a site would be <br /> made by the City, State, or other agencies. He said, if that <br /> determination is made, then the proposed ordinance would relate only to <br /> appropriate screening, and those requirements could be appealed to the <br /> City Council . He said the determination regarding the need to mitigate <br /> toxics is up to the regulatory agency. Mr. Filipovich said there was <br /> no way of knowing that in 20 or 30 years San Leandro might not have to <br /> go back into heavy industry. He also said he was concerned about what <br /> would happen if this screening requirement was expanded. <br /> Council Member Perry said the intent of this amendment to the Zoning <br /> Code is to protect the neighborhoods from noise and other impacts from <br /> mitigation of toxics. <br /> There being no further comments from the public, on motion of Council <br /> Member Myers, seconded by Council Member Polvorosa, and carried <br /> unanimously, the Public Hearing was closed. <br /> Council Member Corbett said she preferred specific language reflecting <br /> the various concerns of the City Council be provided. <br /> Council Member Kerr said he preferred that staff be the reviewing body. <br />
