Minutes - San Leandro City Council Meeting - March 15, 1993 Page - 13 - <br /> NEW BUSINESS (continued) <br /> Council Member Corbett asked how the City would ensure that AB 939 <br /> restrictions are followed by Bio-Mass. Mr. Taylor said the City would <br /> require Bio-Mass to show how much material came through the Facility and <br /> where it goes. He said the permitting authority would also look at where <br /> the material goes; and, if they take it to a land fill , in Novato for <br /> example, that land-fill operator would be required to tell the City and <br /> Bio-Mass would pay for any fines. <br /> Council Member Corbett asked what provisions would be made for handling <br /> hazardous materials. Mr. Taylor said when trucks bring material to the <br /> site it would be dropped into a pit and would be searched by staff, and <br /> anything found would be given back to the operator. He said there would be <br /> additional checks; and, as material is found, it would go back to the <br /> haulers. He pointed out the users of the Facility would not be casual <br /> disposers but franchised haulers. He said those haulers try to remove <br /> hazardous materials from their loads before they take them to any site. <br /> Council Member Corbett asked if there was more than just a site check. Mr. <br /> Taylor said the Facility also contains a lab so material could be checked <br /> if there was a question. He said the worst case is always going to be <br /> assumed. He said liquids will not be allowed through the Facility and said <br /> there was an exhibit in the Agreement that showed what types of materials <br /> were acceptable. <br /> Council Member Myers said he was concerned that there might be an increase <br /> in traffic. Mr. Taylor said the same users as currently use the Transfer <br /> Station would be using the MRF. He said there would be a decrease in <br /> sludge-hauling traffic because sludge would no longer be hauled away from <br /> the Treatment Plant. <br /> Council Member Myers said he noted there was a 2% penalty after 10 days and <br /> asked how long that goes on and how long the company could be in default. <br /> Mr. Taylor said that they would have 30-60 days to cure any non-compliance <br /> with any provision and then the City would take action. <br /> Council Member Myers asked how noise would be handled. Mr. Taylor said <br /> everything at the site is done inside an enclosed building, and they use <br /> electric motors, not diesel engines. He said there are internal as well as <br /> exterior walls and feels there will also be a decrease in noise because no <br /> sludge will be moved. <br /> Council Member Kerr asked if the City had exceeded its 25%-reduction <br /> requirement. Mr. Taylor said there is currently an error in the original <br /> number assigned to the City for waste generation which is being refigured, <br /> and he is working with the Waste Management Authority. <br />
