Minutes. - San Leandro City Council Meeting - May 17, 1993 Page - 21 - <br /> PUBLIC HEARINGS (continued) <br /> In response to questions from Council Member Perry, Mr. King said he <br /> did not have any knowledge of the soils at Mr. Griffin's house, but <br /> there was no indication a problem existed on the subject property. <br /> Council Member Kerr asked if the upper portion of the hill would be <br /> changed. Mr. King said it would not. <br /> Council Member Kerr asked if Mr. King felt this project would make more <br /> dirt go down the hill . Mr. King said ' not with proper construction <br /> techniques, and he said wherever they cut, they would have to install <br /> a v-ditch above the cut to capture the runoff, and this would not cause <br /> any problems. <br /> Council Member Corbett asked what would happen if the engineered fill <br /> was compromised and moved, and what would keep the soil above it from <br /> slipping. Mr. King said bedrock supports the soil . He said improper <br /> drainage makes houses slide, not fill . <br /> Mayor Karp said, if the hill above the project started to slip, people <br /> would say cuts had been made into the hillside. He asked if Errors and <br /> Omissions Insurance would cover this problem. Mr. King said all kinds <br /> of engineers would testify as to what the cause of any slippage would <br /> be. <br /> There being no further comments from the public, on motion of Council <br /> Member Kerr, seconded by Council Member Myers, and carried unanimously, <br /> the Public Hearing was closed. <br /> Steve Meyers explained that the Resolution finds that the project is <br /> consistent with the General Plan, the City Council has reviewed the <br /> Negative Declaration and the comments on it and determined no <br /> significant affect on the environment will occur, and they approve the <br /> Parcel Map with Conditions, per the Engineer's Report, and authorize <br /> the City Manager to approve the Subdivision Improvement Agreement. He <br /> said one Resolution would take care of all of these actions. <br /> Mayor Karp asked for an explanation for the difference between the two <br /> Negative Declarations. Mr. Vogeney reviewed the changes between the <br /> Negative Declaration prepared in August and the Negative Declaration in <br /> the current Council Agenda. He said Appendix E, Part 1, Item 7.2. had <br /> been changed from "no" to "yes" ; Item 6 had been changed from "no" to <br /> "yes." He said Part 2, Item II .1 .g. had been changed from "no" to <br /> "maybe" ; Item b on page 2 from "no" to "yes" ; and Item 18 on page 4 <br /> from "no" to "maybe. " <br /> Council Member Corbett asked why, in Part 2, Appendix E, Item II . 1 .e. <br /> was "no. " Mr. Vogeney said design of the subdivision would not create <br /> increased erosion of soil material because the areas cut for the <br /> retaining walls would be covered with vegetation. <br />
