Minutes - Joint San Leandro City Council/ Page - 3 - <br /> San Leandro Redevelopment Agency/ <br /> Alameda County Board of Supervisors Meeting - June 28, 1993 <br /> JOINT PUBLIC HEARING (continued) <br /> June Catalano, Development Services Director, said this was a joint hearing <br /> of the Alameda County - City of San Leandro Redevelopment Plan. She said <br /> this was a historic occasion. She said the Redevelopment Plan, if passed, <br /> would be the first joint plan in County. She said the Council would serve <br /> in a dual role as City Council and Agency, and the Board of Supervisors <br /> would observe and ask for comments. She said the Board of Supervisors <br /> would hold a hearing at their July 8th meeting and noted both City and <br /> County staff were available to answer questions. <br /> Adolph Martinelli , Alameda County Planning Director, said during the <br /> various public meetings leading up to this hearing, the most controversial <br /> issue in the unincorporated area was the subject of Eminent Domain. He <br /> said Eminent Domain was proposed for consideration for all properties along <br /> East 14th and on Lewelling at I-238. He said, at the request of <br /> Supervisors King and Steele this had been greatly reduced, and Eminent <br /> Domain was now only being 'considered on 48 parcels out of the 450 <br /> originally contemplated. He said the properties are generally in an area <br /> significantly impacted by freeway improvements, and there was a diagram in <br /> the lobby which illustrated this. <br /> June Catalano entered into the record the following documents: Exhibit 1, <br /> Affidavit of Publication of Notice of Joint Public Hearing, published once <br /> a week for four successive weeks in the Daily Review as required by <br /> Sections 33349 and 33361 of the Health and Safety Code. Exhibit 2, <br /> Certificate of Mailing Notice to Property Owners of the Joint Public <br /> Hearing, together with a statement concerning acquisition of property by <br /> the Agency, to each assessee of land in the Project Area as shown on the <br /> last equalized assessment roll as required by Sections 33349 and 33350 of <br /> the Health and Safety Code. Exhibit 3, Certificate of Mailing Notice to <br /> Taxing Agencies as required by Section 33349 of the Health and Safety Code. <br /> Mayor Faria called the joint public hearing open. He said the State Law <br /> under which the Council/Agency was acting is the Community Redevelopment <br /> Law of the State of California. He said that law requires certain <br /> procedures, some of them formal , in the conduct of the joint public <br /> hearing. He said the City Clerk was present and a formal transcript would <br /> be made available. He said the transcript and all evidence presented and <br /> testimony given would become part of the official record of proceedings on <br /> the adoption of the Redevelopment Plan and related documents, and would be <br /> used as evidence and may be filed with a court in the event any of the <br /> proceedings or documents relating to the Plan adoption process are <br /> challenged in a court of law. He said all persons desiring to speak would <br /> be given an opportunity to do so and any questions would be directed <br /> through the Chair. He said this was a combined hearing on both the <br /> Redevelopment Plan and the Certification of the Final Environmental Impact <br />
