Matter of A-93-1 ; Reclassification; Re-Zone from R-1 (Single-Family) <br /> District to P (Professional ) District; 1222 - 136th Avenue and 13608 <br /> Rose Drive; Southeast Corner of 136th Avenue and Rose Drive; Assessor's <br /> Parcel Number 77D-1416-43 and 44; Galen Health Care, Inc. , dba San <br /> Leandro Hospital . <br /> Council Members Myers and Perry said they had a source of income from <br /> San Leandro Hospital , and, therefore would not participate in the <br /> Hearing. <br /> Mayor Faria pointed out that this matter would require four votes. <br /> This being the time and place for the Public Hearing on the above <br /> matter, Norm Weisbrod, Associate Planner, said the subject properties <br /> are on 136th Avenue, zoned R-1, and consist of single-family homes. He <br /> said to the rear of the homes is San Leandro Hospital , which owns the <br /> two subject parcels as well as two other homes. He said the Hospital <br /> has applied for the re-zone from R-1 (Residential ) District to P <br /> (Professional ) District and proposes to use the single-family homes for <br /> Hospital -related purposes. He said one home would be used for the <br /> Accounting Office, with approximately four employees, and the other <br /> would be used for the Senior Friends Association and have approximately <br /> four employees providing services to senior citizens. <br /> He said the Planning Commission held a Hearing on March 25, and a <br /> number of residents on the street asked for more time to study the <br /> proposal . He said another Hearing was held on May 27, and the <br /> residents and Hospital representatives met to discuss concerns. He <br /> said the primary concerns were related to any change in appearance of <br /> the two single-family homes so. they would no longer resemble <br /> residential homes, hours of operation, parking by employees or patients <br /> or clients on residential streets, and a desire to keep the masonry <br /> wall . He said the Hospital and residents reached an agreement which <br /> was signed by both parties. He said, if the Hospital wants to convert <br /> the two homes to Hospital uses, they would be required to obtain a <br /> Conditional Use Permit through the Board of Zoning Adjustments. He <br /> said this would require a Public Hearing and public notification. He <br /> said the Conditions that are in the Agreement could also be placed on <br /> the Conditional Use Permit so they would be enforceable by the City. <br /> He said, by placing the Conditions in the Conditional Use Permit, they <br /> would be binding on the Hospital and enforceable by City staff, as <br /> compared to an agreement between the two parties, which would not be <br /> enforceable by the City. He said the Planning Commission recommended <br /> approval of the re-zoning. <br /> Mayor Faria asked how this re-zone fit in with the General Plan. Mr. <br /> Weisbrod said the General Plan does not define land use closely, and <br /> this is in conformance. <br />
