On motion by Council Member Corbett, who moved <br /> its approval , seconded by Council Member Kerr, and carried by the <br /> following called vote, the City Council approved PD-93-3, GDP; Planned <br /> Unit Development, General Development Plan. (1009) <br /> AYES: Council Members Corbett, Kerr, Myers, Perry, Polvorosa; <br /> Mayor Faria ( 6 ) <br /> NOES: None ( 0 ) <br /> ABSENT: Council Member Nahm ( 1 ) <br /> ' C. Matter of PD-91-3. PDP; Roberts' Landing Precise Development Plan. <br /> This being the time and place for the Public Hearing on the above <br /> matter, Steve Emslie, Planning Manager, provided introductory comments <br /> and an overview. He introduced staff members and consultants available <br /> to answer questions and said the Applicant was in attendance with his <br /> land use and hazardous material consultant. He said the purpose of the <br /> Hearing was to hear from the public regarding the amendment to the <br /> General Development Plan which would allow for setback of not more than <br /> 10 lots to 10 feet; the Development Agreement; the Vesting Tentative Map <br /> for Phase 1A; and the recommended approval of the Precise Development <br /> Plan, including specific lotting and street pattern for the first phase <br /> of the General Development Plan. He explained the EIR was a <br /> Supplemental Environmental Impact Report which supplemented the EIR the <br /> Council certified last year when it approved the General Development <br /> Plan, and which was an outgrowth of the General Development Plan EIR. <br /> He said both of these documents constituted the record. He said CEQA <br /> requirements for public review and public comment had already been <br /> satisfied. He said the Precise Development Plan and the General <br /> Development Plan address separate issues; the General Development Plan <br /> EIR addresses the full range of issues and the Precise Development Plan <br /> specifically talks about toxics, hazardous materials, buffer, and <br /> drainage pattern. He explained the two-step process the City uses in <br /> making approvals -- the General Development process and the Precise <br /> Development process. He said the two EIR's constitute the City's <br /> approval of the project, are consistent and remain with the project <br /> throughout the end. He said the GDP and the PDP both apply equally and <br /> remain in full force until the project is converted to an alternate land <br /> use. He said he received an anonymous call from someone who was unable <br /> to attend due to illness but opposes the project based on concerns <br /> regarding toxic contamination and the potential threat to public safety, <br /> health and welfare and who felt it should retain the environmental <br /> qualities of a wildlife habitat. <br />
