Minutes - San Leandro City Council Meeting - December 20, 1993 Page - 9 - <br /> NEW BUSINESS (continued) <br /> sample, and have analyzed the results and proposed a process to <br /> eliminate problems by removing soil . <br /> In response to Council questions, Mr. Oates said the trail would be <br /> outside the 50' buffer zone; and if Citation development occurs, <br /> Citation must receive appropriate Section 7 approval from U.S. Fish and <br /> Wildlife. He said testing for nitrocellulose also reveals nitrostarch. <br /> He said the environmental conditions on the site are such that they <br /> would destroy the explosive tendencies of nitrostarch. <br /> Regarding flooding and BCDC jurisdiction, he said BCDC takes <br /> jurisdiction up to the line of highest tidal action, and BCDC approval <br /> is still needed. He said if they determine that a higher level falls <br /> into their jurisdiction, it has no practical bearing on this project <br /> because their approval is already required. <br /> He said, related to explosives, Harding Lawson's data was used, but not <br /> their analysis. <br /> He said the trail will be bladed dirt, with gravel on some portions. <br /> He described the alignment of the trail and the condition of the <br /> bridge. He said no fill would be imported for the islands, but <br /> material excavated from the culverts would be used. <br /> Bill Silva said the City has met all requirements; and permits are <br /> needed from State Lands, Corps of Engineers, and Regional Water Quality <br /> Control Board. He said he hopes to see construction start in the <br /> Spring of next year. <br /> The following Resolution was then introduced: <br /> Resolution No. 93-258, Resolution Adopting Negative Declaration, <br /> Findings, and Mitigation Monitoring Plan for the Water Circulation and <br /> Drainage Plan and Authorizing the City Manager to Negotiate and Enter <br /> into a Lease with the State Lands Commission for the Construction and <br /> Operation of the Water Circulation and Drainage Plan on Land Leased <br /> from the State Lands Commission (San Leandro Shoreline Marshland <br /> Enhancement Project, Project No. 94-8673) (certifies Negative <br /> Declaration as complete and in compliance with CEQA requirements for <br /> the implementation of the Water Circulation and Drainage Plan and <br /> provides for entering into a lease with the State Lands Commission for <br /> the Construction and Operation of the Water Circulation and Drainage <br /> Plan on land leased from the State Lands Commission) .
