Minutes - San Leandro City Council Meeting - May 2, 1994 Page - 15 - <br /> PUBLIC HEARINGS (continued) <br /> Council Member Myers said the Planning Commission did not have all of <br /> the information the City Council has been presented with this evening. <br /> He said he did not feel there was a safety issue and felt the mural <br /> should be permitted, in accordance with the Conditions recommended by <br /> staff. <br /> Council Member Kerr agreed. He also felt the Planning Commission had <br /> inadequate information. He said the mural was not a hazard and should <br /> be approved, in keeping with Conditions. <br /> Council Member Polvorosa concurred. He said he was concerned that Mrs. <br /> Campbell knowingly violated the law. <br /> Council Member Perry said the issue is not content but public health <br /> and safety. She noted San Leandro does support the arts and has for a <br /> long time and pointed out the theater displays at the library and other <br /> public art in the City. <br /> The following Motion was then introduced: <br /> Minute Order No. 94-22, Matter of Appeal by Alice Campbell of the <br /> Planning Commission's Denial of ZEO-94-1; Zoning Enforcement Official <br /> Action; Referred by the Zoning Enforcement Official to the Planning <br /> Commission; to Paint a Non-Commercial Mural Measuring Approximately <br /> 120' by 15' , Divided Into Panels 3' Wide by 5' High; the Mural Proposed <br /> for the Side of a Warehouse Would Be Visible from San Leandro Boulevard <br /> and the Elevated BART Tracks; 520 Harlan Street; Assessor's Parcel <br /> Number 75-70-31 ; Alice Campbell , Applicant and Property Owner; IL <br /> (Industrial Limited) District. (2761) <br /> On motion by Council Member Perry, who moved its approval , seconded by <br /> Council Member Kerr, and carried by the following called vote, the City <br /> Council accepted staff recommendations, with Conditions, including a <br /> fee for staff costs associated with enforcement of the Zoning Code. <br /> AYES: Council Members Galvan, Kerr, Loeffler, Myers, Perry, <br /> Polvorosa; Mayor Corbett ( 7 ) <br /> NOES: None ( 0 ) <br /> ABSENT: None ( 0 ) <br /> Mayor Corbett said no safety hazard had been found in connection with <br /> the mural . She said processes in place can be used for positive <br /> change. By not utilizing the processes, the City Council 's opportunity <br /> to make a decision is taken away from it. The process in San Leandro <br /> can protect us if used properly. She said the City Council cannot <br /> condone anyone taking the law into their own hands. She said the <br /> Planning Commission decision was appealable to the City Council . She <br /> said Mrs. Campbell 's actions in violating the Code sent a terrible <br /> message to a society already troubled by lawlessness. <br />
