He said this was unreasonable. He said Bill Algire told him <br /> today there would be a change in the recommendation, and costs would be <br /> approximately $1 , 100. He said the developer felt this had never been <br /> discussed before and has never been imposed before in San Leandro and <br /> should not be imposed now. He said it was a matter of policy that <br /> should go before the City Council . <br /> In response to a question from Council Member Perry, Bill Algire <br /> explained how the pro-rata share would be determined. <br /> Council Member Faria made a motion, seconded by Council Member <br /> Polvorosa, to approve the Resolution Approving the Tentative Map. <br /> Mayor Karp said developers are often delayed by policy made by staff, <br /> and it is up to City Council , not staff, to make those policy <br /> decisions. He said this developer has been delayed for two years. <br /> Steve Meyers, City Attorney, asked what the action of the Planning <br /> Commission was and if it was consistent with the Engineer' s <br /> recommendation. Mr. Penaranda said the Planning Commission's <br /> recommendation did not include Engineering's Condition No. 7 . <br /> Council Members Faria and Polvorosa withdrew their motion. <br /> Council Member Faria then made a motion to approve the Resolution with <br /> deletion of Condition No. 7 of the Engineer' s Report. The motion was <br /> seconded by Council Member Perry. The motion failed, with Mayor Karp <br /> and Council Members Perry and Faria voting yes and Council Members <br /> Santos, Corbett, Glaze, and Polvorosa voting no. <br /> Mayor Karp said this action by the City Council sent a message to <br /> developers that their business is not wanted in San Leandro. <br /> The following Resolution was then introduced: <br /> RESOLUTION NO. 92-12 (2700) <br /> RESOLUTION APPROVING TENTATIVE MAP <br /> VESTING TENTATIVE MAP, TRACT 6494 <br /> 262-282 ESTABROOK STREET <br /> Introduced by Council Member Santos, who moved its adoption, seconded by Council <br /> Member Glaze, and carried by the following called vote: <br /> AYES: Council Members Corbett, Glaze, Polvorosa, Santos; ( 4 ) <br /> NOES: Mayor Karp and Council Members Faria and Perry ( 3 ) <br /> ABSENT: None ( 0 ) <br />
