Minutes - San Leandro City Council Meeting - January 6, 1992 Page - 11 - <br /> NEW BUSINESS (continued) <br /> Council Member Faria said he thought the sewer-connection fee would pay <br /> for this type of work. Bill Algire said the connection fee provides <br /> enhancement to the Water Pollution Control Plant but does not pay for <br /> up-sizing sewers. <br /> Mayor Karp said he felt this action would penalize this developer. <br /> In response to a question from Council Member Corbett, Mr. Algire said <br /> staff was asking for policy direction on this issue. <br /> Council Member Santos asked if the sanitary system for the area was <br /> adequate now. Staff said it was but it may need to be up-sized after <br /> the review is conducted. Council Member Santos said he felt it was <br /> reasonable for the developer to pay if up-sizing was needed. <br /> Mayor Karp said we don't have a policy requiring such up-sizing now. <br /> He said this developer has suffered many delays and this Condition was <br /> a surprise to the developer. <br /> Council Member Glaze asked what the process was that brought this <br /> development before the City Council . <br /> Elmer Penaranda explained that the application was a combined <br /> Conditional Use and Site Development. He said multi-residential <br /> requires Site Development and condominiums require Conditional Use, so <br /> the Map had gone to the Board of Zoning Adjustments and then to the <br /> Planning Commission. He said staff is currently reviewing this process <br /> and will be recommending modifications. <br /> In response to comments by the City Council , Acting City Manager Mike <br /> Oliver said the Engineering staff is looking at a number of issues, <br /> such as replacement and capacity of sewer lines, as zoning density and <br /> zoning designations change throughout the City. <br /> Glenn Forbes, attorney for the developer, said the developer originally <br /> applied for approval of a 23-unit apartment structure, but this was not <br /> approved by staff and the Board of Zoning Adjustments, so the developer <br /> came back with a plan for a 14-unit condominium. He said the developer <br /> worked with staff and made extensive changes as a result of staff <br /> requirements. He said they hired a consultant from San Francisco to <br /> review the plans, as recommended by staff. He said everyone liked the <br /> original 14-unit condominium proposal , and when the proposal went <br /> before the Board of Zoning Adjustments, there was no mention of the <br /> need to possibly up-size the sewer. He said it was approved by the <br /> Board of Zoning Adjustments without any reference to the sewer. He <br /> said since this is a condominium, it required a Subdivision Map, which <br /> required approval by the Planning Commission. He said when this matter <br /> went before the Planning Commission that was the first time the sewer- <br /> line issue was brought up. He said the original Condition was that the <br />
