He said the <br /> City needs to go back to the drawing board and work with the community. <br /> He said he does not want to see any new programs, and he felt any <br /> hiring should come through the City Council . He said everyone may have <br /> to work a little harder. He said we should work with the community and <br /> ask them to volunteer their help, and there should be more business and <br /> community involvement. <br /> Council Member Perry asked for an explanation of the difference between <br /> her proposal and that made by Council Member Corbett. She asked if the <br /> enabling Ordinance could be re-enacted at a future date. <br /> City Attorney Steve Meyers said, as a Charter City, San Leandro has the <br /> ability to create assessment districts. He said the Essential City <br /> Facilities and Services District could be created under State law, but <br /> the Disaster Preparedness Facilities and Services District needed to be <br /> enabled by Ordinance. He said, without the Ordinance, the City Council <br /> could not proceed with the Disaster Preparedness Assessment District. <br /> He said the City Council could repeal the Ordinance tonight and re- <br /> enact an amended Ordinance at any time. He said the enabling Ordinance <br /> is subject to referendum. He said petitions are being circulated now <br /> and would probably not qualify in time for the June ballot. He said a <br /> special election would probably need to be held in November to be <br /> consolidated with the November election. He said if the City Council <br /> chooses to rescind the Resolutions and Ordinance, they should rescind <br /> the Consultant Services Agreement first, then the two Resolutions <br /> initiating proceedings, and then the enabling Ordinance. He said if <br /> the City Council repealed these actions they could re-enact or modify <br /> them in the future. <br /> Council Member Perry asked if termination of the BSI contract put the <br /> Assessment District process on hold. Steve Meyers said yes because it <br /> would terminate staff's ability to proceed with the Assessment <br /> Districts. <br /> Council Member Corbett said her proposal would allow the City to look <br /> at all suggestions for cost cuttings and savings. She asked if the <br /> enabling Ordinance could be rescinded at a later time after community <br /> discussion. Mr. Meyers said yes and that, even if the referendum <br /> qualified, the City Council could still repeal the Ordinance. <br /> Council Member Corbett, seconded by Council Member Faria, made a motion <br /> to amend the motion made by Council Member Perry to eliminate <br /> rescission of the enabling Ordinance from the original motion. The <br /> substitute motion rescinded Resolution No. 92-24, Relating to <br /> Assessment District No. 100, Disaster Preparedness Facilities and <br /> Services District; rescinded Resolution No. 92-25, Relating to <br /> Assessment District No. 101, Essential City Facilities and Services <br /> District; and rescinded Resolution No. 92-26, Contractual Services <br /> Agreement with BSI Consultants, Inc. , Regarding Assessment Districts <br /> No. 101 and No. 102. <br />
