Matter of Condemnation of Property Located at 1701 Marina Boulevard, <br /> 2550 Merced Street, and 1735 Fairway Drive (Lucky Stores) for Aladdin <br /> Avenue/Fairway Drive Overcrossing Project. Continued from the April 6, <br /> 1992, City Council Meeting. <br /> This being the time and place for the Public Hearing on the above <br /> matter, Rob Caughell , Engineering and Transportation Department, said <br /> this matter had been continued from the April 6, 1992, City Council <br /> Meeting. He said the property is part of the Lucky Stores Distribution <br /> Center and is needed for the Aladdin Avenue/Fairway Drive Overcrossing <br /> Project. He said this is the last, major piece of property to be <br /> acquired for the project. He said a number of offers have been made. <br /> He said it is necessary to proceed with Eminent Domain Proceedings in <br /> order not to delay the project. He said the Resolution gives the City <br /> Attorney the authority to proceed with Eminent Domain. He described <br /> the size and locations of each strip of property to be included in <br /> Eminent Domain Proceedings. <br /> The Hearing was then opened to the public. <br /> Lou Filipovich, 15376 Laverne Drive, asked if Lucky's objected to the <br /> Eminent Domain Proceedings. He asked if the parcels were being <br /> negotiated for individually or as a whole. Mr. Caughell said the <br /> reason the City is undertaking Eminent Domain Proceedings is because it <br /> takes a long time to get through the corporate offices of Lucky's. Mr. <br /> Meyers said he thinks this matter will be resolved with Lucky's before <br /> it goes to court. <br /> There being no further comments from the public, on motion of Council <br /> Member Polvorosa, seconded by Council Member Faria, and carried <br /> unanimously, the Public Hearing was closed. <br /> Mr. Meyers noted the City Council has now had a number of Hearings and <br /> meetings regarding Measure B and asked that the City Council <br /> incorporate all prior Hearings and discussions into this matter. <br />
