Minutes - San Leandro City Council Meeting - August 17, 1992 Page - 15 - PUBLIC HEARINGS (continued) There being no comments from the public, on motion of Council Member Polvorosa, seconded by Council Member Perry, and carried unanimously, the Public Hearing was closed. The City Council moved to approve the Resolution. City Attorney Steve Meyers noted this required a two-thirds vote and felt this required six votes. There was a motion to table the Resolution. It was then determined that five votes constituted a two-thirds majority, and it was moved by Council Member Polvorosa, seconded by Council Member Faria, and carried unanimously, to reconsider the matter. It was moved by Council Member Polvorosa, seconded by Council Member Faria, and carried unanimously, to remove the tabled vote. The following Resolution was then introduced: - Resolution No. 92-241 , Resolution of Necessity Authorizing the Acquisition of Certain Property for Measure B - Marina Boulevard Widening and Teagarden Street Extension Projects and Finding That the Public Interest and Necessity Require the Proposed Project, That the Location Thereof Causes the Least Private Injury, That the Subject Property is Necessary for the Proposed Project (Vacant Property at Marina Boulevard and Teagarden Street - Southern Pacific Transportation Company) (authorizes the City Attorney to petition the court to begin eminent domain proceedings against Southern Pacific Transportation Company) . (1206) Introduced by Council Member Kerr, who moved its adoption, seconded by Council Member Faria, and carried by the following called vote: AYES: Council Members Faria, Kerr, Perry, Polvorosa; Mayor Karp ( 5 ) NOES: None ( 0 ) ABSENT: Council Members Corbett and Myers ( 2 )
