On motion by Council Member Faria, who moved <br /> its approval , seconded by Council Member Polvorosa, and carried by the <br /> following called vote, the City Council denied certification of the <br /> Negative Declaration of Environmental Impact for Parcel Map 5845. <br /> (2718) <br /> AYES: Council Members Faria, Perry, Polvorosa; Mayor Karp ( 4 ) <br /> NOES: Council Member Kerr ( 1 ) <br /> ABSENT: Council Members Corbett and Myers ( 2 ) <br /> City Attorney, Steve Meyers, noted that, under the Subdivision Map, the <br /> Applicant must either withdraw his Application or waive his rights to <br /> time limits. <br /> Mr. Silva asked if Mr. Lu would approve additional time for staff to <br /> pursue the issues which the City Council had identified and to <br /> determine if an Environmental Impact Report was required. <br /> Mr. Meyers explained there are certain time limits the City must meet <br /> in processing Applications. He recommended the City Council deny the <br /> Parcel Map unless Mr. Lu waived those time limits. Mr. Lu waived all <br /> time limits. <br /> Mr. Meyers noted this matter would again be listed on the Agenda and <br /> come back before the City Council . <br /> 8. PUBLIC HEARINGS <br /> A. Matter of Condemnation of Property Located at Marina Boulevard and <br /> Teagarden Street (Southern Pacific Transportation Company) for Measure <br /> B - Marina Boulevard Widening and Teagarden Street Extension Projects. <br /> It was noted there was no representative of Southern Pacific <br /> Transportation Company in the audience. <br /> This being the time and place for the Public Hearing on the above <br /> matter, Rob Caughell , Administrative Assistant, noted the subject <br /> Resolution was a Resolution of Necessity requesting approval for the <br /> City Attorney to proceed with the Eminent Domain Procedure on the <br /> property. He said the property in question was related to the Marina <br /> Boulevard\Teagarden Street Extension Projects and consisted of pieces <br /> of abandoned spur lines and small pieces of frontage on Marina <br /> Boulevard and Teagarden Street. <br /> The Hearing was then opened to the public. <br />
