Minutes - San Leandro City Council Meeting - December 21, 1992 Page - 8 -
NEW BUSINESS (continued)
The following Resolution was then introduced:
Resolution No. 92-322, Resolution Approving Contractual Services
Agreement with G. T. Kuntz, Consulting Engineer, Relating to East 14th
Street Light System Improvement, Phase I , Project No. 92-8356 (provides
for the replacement of street light electrical systems along three
segments of East 14th Street: Toler Avenue to Chumalia/Hays, Estudillo
to Maud/Thornton, and Blossom Way to Bayfair Drive) . (2323)
Introduced by Council Member Perry, who moved its adoption, seconded by
Council Member Polvorosa, and carried by the following called vote:
AYES: Council Members Faria, Kerr, Myers, Perry, Polvorosa;
Mayor Karp ( 6 )
NOES: None ( 0 )
ABSENT: Council Member Corbett ( 1 )
B. Resolution Approving Extension of Time for Completion of Subdivision
Improvement Agreement (Public Improvements) , Tract 6379, Marina Vista,
Phase I ; Developer: H. F. Properties, Ltd. (grants six-month time
extension for completion of public improvements at the Marina Vista
Project on Wicks Boulevard) .
Council Member Myers said the staff report states the contractor was
unable to meet the deadline because of rain. He asked if the developer
was asking for another six months and what would happen if the City did
not allow the extension.
Steve Meyers, City Attorney, said the subdivision improvements are
guaranteed by a Performance Bond; and, if the work is not done, the
City can call the Bond and have the bonding company stand in the place
of the developer. Mr: Silva said he recommended approving the
extension of time because the developer had been working in good faith
but had been hampered by weather conditions.
Council Member Faria noted the condition that said the developer could
not open any models until the public improvements are in and said this
would undoubtedly speed the work along.
Council Member Kerr asked why meandering sidewalks were required.
Mayor Karp explained that this was part of the approved plan for the
development.
Mayor Karp said, if the developer does any work that shuts down
utilities or otherwise disrupts the mobilehome park, the park should
receive adequate advance notice.
