Minutes - San Leandro City Council Meeting - February 19, 1991 Page - 8 - <br /> PUBLIC HEARINGS (continued) <br /> Dan Ryan, 109 Jackson Street, Hayward, a realtor representing Mrs. <br /> Pennington, spoke on her behalf. He said her home is unique because it <br /> has a basement. He said the County allowed her living space to include <br /> the basement. He passed out lists of homes now available for sale, sale <br /> pending, etc. , and said there were no comparable homes on the market in <br /> the $185,000 range, which was Mrs. Pennington's relocation amount. He <br /> also said she would not have had to pay her husband the $40,000 if the <br /> City had not acquired her home. <br /> Mr. Fenstermacher said the appraisal of the property was done at the peak <br /> of the real estate market. Mr. Fenstermacher again said that the debt <br /> to Mrs. Pennington's ex-husband must be treated the same as any other <br /> loan and could not be taken into consideration in determining relocation <br /> assistance. <br /> The City Council asked questions related to the market area and the type <br /> of appraiser utilized. <br /> The Hearing was then opened to the public. <br /> Edward L. Grace, 1267 Orchard Avenue, said he lives in the same <br /> neighborhood as Mrs. Pennington. He said he understood the purpose of <br /> the property acquisition was to make Thrasher Park prettier. He said <br /> children cannot be sent to the park alone because of the people who <br /> frequent the park. He said people in the neighborhood are being forced <br /> to move and go into debt, and Mrs. Pennington's divorce lien would not <br /> have been pressed into service if she was not forced to move. <br /> Dan Ryan summarized by saying Mrs. Pennington wanted a 1,500- to 1,800- <br /> square-foot, 3-bedroom, 1-bath, 2-car-garage replacement home. He noted <br /> that her ex-husband was not going to make her pay the lien and she had <br /> not been making payments on it. <br /> There being no further comments from the public, on motion of Council <br /> Member Glaze, seconded by Council Member Faria, and carried unanimously, <br /> the Public Hearing was closed. <br /> MINUTE ORDER NO. 91-14 (1-267/1885-2) <br /> MOTION DENYING RELOCATION ASSISTANCE APPEAL <br /> OF BONNIE PENNINGTON <br /> 1234 ORCHARD AVENUE <br /> THRASHER PARK MASTER PLAN <br /> On motion by Council Member Faria who moved its approval , seconded by Council <br /> Member Santos and carried by the following called vote, the City Council denied <br /> the Appeal and upheld staff's recommendation. <br /> AYES: Council Members Corbett, Faria, Glaze, Perry, Polvorosa, Santos; <br /> Mayor Karp ( 7 ) <br /> NOES: None ( 0 ) <br /> ABSENT: None ( 0 ) <br />
