Minutes - San Leandro City Council Meeting - June 3, 1991 Page - 18 - <br /> PUBLIC HEARINGS (continued) <br /> the terms of the deed, the City Council was able to act only upon the <br /> terms of the City's Zoning Ordinance. <br /> Pastor Bolene, St. James Lutheran Church, said in 1960 St. James applied <br /> for a permit to build the church recreation hall and classrooms. He <br /> said a condition of the permit was that windows facing Mrs. Bernie's <br /> property be made of glass that would afford a measure of privacy to Mrs. <br /> Bernie. He said child care is an important service to the community <br /> and the parents are concerned that they have a place for their children <br /> to be nurtured. He said this is a much needed program in the community. <br /> Cindy Breeden, Director of the Christian School at St. James, said the <br /> before and after school program has been requested by the citizens of <br /> San Leandro. She noted statistics regarding the need for child care. <br /> She said this is a high quality program with a two-year waiting list. <br /> She said the church has a number of ideas to eliminate the noise and <br /> they are very willing to work with the neighbors. She said they would <br /> be willing to eliminate the tall play structure next to the condominiums <br /> and replace it with a grass area and a sun shade to cut down on noise. <br /> Ann Shiavello, 972 Joaquin, Board of Directors, Joaquin-Murietta <br /> Homeowners Association, said the peace of her home has been violated <br /> since St. James was given a permit for the pre-school program. She said <br /> the noise both from the inside and outside areas of the school is <br /> intolerable. She said 14 windows face Mrs. Bernie's home and six <br /> windows face the condominium and even when St. James' windows are closed <br /> the noise is excessive. She said the proposal will increase the number <br /> of children on the site to 70, as well as increase the number of cars <br /> and busses coming to the site. <br /> John Shiavello, 972 Joaquin Ave. , said within the past five years he <br /> has suffered a living hell because of the noise from the school . He <br /> said there is no control by the director or assistants to control the <br /> noise. He said the area is too small for this activity. <br /> Mrs. Berger, Joaquin-Murietta Condominiums, said this proposal is a <br /> violation of her consumer rights. She said the property is not <br /> appropriate for a school and the area is dangerous to the children <br /> because access problems could occur in case of an earthquake or fire. <br /> Karen Gallagher, Martell Ave. , said she has a child at the school and <br /> it is important to her to know that her child is safe and well cared <br /> for. <br /> Percy Yang said he has a daughter in the pre-school and plans to enroll <br /> his son in the program. He said this is a good quality school and the <br /> lack of adequate child care is a national problem. <br /> Ellen Geis, Estudillo Homeowners Association, said she was unable to <br /> attend the Board of Zoning Adjustments hearing on this matter. She said <br /> the Association had never been contacted by the Joaquin-Murietta <br /> Homeowners Association. <br />
