Miscellaneous Matter of: PD-89-10; Appeal of Applicant, Signature <br /> Properties. Inc. . from Planning Commission Denial of Planned Unit <br /> Development (General Development and Precise Development Plan Combined); <br /> a Proposal to Construct 126 Detached, Single-Family Residential Units on <br /> the 60-Acre Site Formerly Occupied by the San Leandro Rock Quarry; <br /> Assessor's Parcel Numbers 79-100-001, 002; 13575 Lake Chabot Road; Signature <br /> Properties, Inc. ; Alameda County - "A" (Agricultural ). <br /> Mayor Karp explained that tonight's meeting was a continuation of the June <br /> 3, 1991 City Council meeting, which had resulted in a tie vote on this <br /> matter. He said the City Council had closed the matter for public <br /> testimony. He said the purpose of tonight's meeting was for the <br /> presentation of further information to the City Council for its deliberation <br /> and debate. <br /> City Attorney Steve Meyers said the City Council had considered three <br /> actions at the June 3, 1991 meeting: 1) the matter of certification of the <br /> Environmental Impact Report (EIR) for the project, 2) the matter of <br /> prezoning of the property, and 3) the appeal of the Planning Commission's <br /> denial of the Planned Development. He said the City Council approved the <br /> EIR and the pre-zoning, but a proposal to approve the General Development <br /> Plan and Precise Development Plan for PD-89-10 resulted in a tie vote, which <br /> is the same as no action. He said under conditions of the City's Zoning <br /> Code, after a public hearing, the City Council may approve or deny an <br /> application. Failure to take action within 30 days constitutes disapproval . <br /> The 30 day deadline in this instance would be July 3, 1991 . He said the <br /> City Clerk has been directed to list this item on the City Council agenda <br /> until the 30 days period is concluded, which would be July 3, 1991 , or <br /> until some action is taken. He said since the public hearing has been <br /> concluded, the City Council cannot hear public testimony without reopening <br /> the public hearing. He said if the City Council wished to make substantive <br /> changes to the project, it would be necessary to refer the project back to <br /> the Planning Commission for additional consideration. He said all required <br /> legal notice of the meeting had been given. <br /> June Catalano, Planning & Building Director, discussed the outstanding <br /> planning issues related to the project. She said the City Council had <br /> approved the EIR and prezoning and now had to decide how to implement those <br /> actions. She said the City had retained three independent technical experts <br /> to address geology and structural issues which were of concern to the City <br /> Council . <br /> The City Council asked questions related to the requirement for installation <br /> of two 24" box trees at each home, where would they be in relationship to <br /> lake view, and whether they would create a buffer of the view of the project <br /> from Lake Chabot. They asked if the common area would be fully landscaped. <br /> The City Council asked what penalties would be imposed if properties owners <br /> removed any required landscaping. <br />
