Jorgensen of Determination of Board of Appeals Decision Regarding 227-37, 45, 51, 59 East 14th Street and 112- 114-116-120 Garcia Avenue, San Leandro, CA (appeals Determination of Board of Appeals related to application of requirements of the City's Unreinforced Masonry Building Program to the Mission Bell Apartments and Stores) . June Catalano, Planning & Building Director, reviewed the history of the City's Unreinforced Masonry Buildings Compliance Program. She provided background on the creation of the program and described the current requirements. She noted that Mr. Jorgensen had hired EQE Company to prepare the required engineering analysis of his building and said the City had not received the engineering report yet. She said Mr. Jorgensen had appealed to the Board of Appeals the determination made by the Building Official that the Mission Bell Apartments and Stores constitute an Unreinforced Masonry Building (URMB) , as defined by the City's Ordinance, and said the Board had denied the appeal . She said Mr. Jorgensen had appealed the Board's denial to the City Council . She said Mr. Jorgensen was requesting an eight-month extension to submit his engineering report; the ability to develop his own timeline for retrofit, but with at least two additional years in addition to the time provided by the City Ordinance; and approval to develop his retrofit program in accordance with the standards of the Uniform Code for Building Conservation (UCBC) , rather than the standards in the City's Ordinance. Ms. Catalano noted that Mr. Jorgensen's request would require an amendment to the City Ordinance. She introduced Bruce Cameron, JWD Engineers, and said he would be able to answer technical questions for the City Council . Council Member Faria said he had heard there was a group of Building Officials who had developed building standards that are different from the City's URMB Standards. Mr. Cameron said the Structural Engineers Association had developed some guidelines, but it is up to each individual city to develop its own standards. He said San Leandro's standards are in the middle in terms of strictness. Steve Meyers, City Attorney, said the City's Ordinance providing for retrofit of URMB's, adopted in February of 1990, was delayed by 180 days, as directed by the City Council . He said the Ordinance requires that a property owner provide a structural analysis within one year of service and order. He said the subject of the appeal before the City Council tonight was the Building Official 's determination that Mr. Jorgensen's building is a URMB. He said Mr. Jorgensen had asked for
