He <br /> said the time limitations in the Ordinance are mandatory; nothing in <br /> the Ordinance allows the City Council to change the time lines unless <br /> they choose to amend the Ordinance. He said the subject matter before <br /> the Council does not allow the Council to grant Mr. Jorgensen's request. <br /> He said the only thing before the City Council was whether the Building <br /> Official was correct in his determination that the subject property is <br /> a URMB. <br /> Blaine Brassfield, Building Official , said his determination that the <br /> Mission Bell building is unreinforced masonry was based on EQE Company's <br /> initial survey of San Leandro to determine which buildings are <br /> unreinforced masonry, according to the parameters of SB547. He <br /> described the status of actions taken to date by owners of other <br /> buildings in San Leandro. He said the initial engineering analyses on <br /> the buildings are due by November 30, 1991 . <br /> The City Council asked questions regarding the appeal process in the <br /> Ordinance. The City Attorney explained that determinations by the <br /> Building Official may be appealed throughout the process, but the time <br /> lines in the Ordinance are not subject to appeal . <br /> Mr. Brassfield further described the time lines in the Ordinance. He <br /> said any determination he makes can be appealed to the Board of Appeals <br /> at any point in the process. <br /> Dave Jorgensen, the appellant, said it is not his intention to request <br /> an amendment to the Ordinance with this appeal . He said his appeal is <br /> consistent with the Notice and Order. He said his appeal puts the <br /> Notice and Order in abeyance until his appeal is heard and then a new <br /> Notice and Order must be issued. He said in June, Mr. Brassfield had <br /> told him there would be only two Notice and Orders, and it was his <br /> understanding these would be the only times he could appeal . He said <br /> the Mission Bell is a unique building as it relates to the URMB list. <br /> He said it is the only building primarily designated as residential and <br /> described it as a landmark building that guards the North Area. He said <br /> it has withstood all earthquakes since it was built in 1927. He said <br /> it is also designated as a non-bearing wall unreinforced masonry <br /> building. He said non-bearing walls might mean there are a lot of cross <br /> walls with steel that add to the internal strength of the building. <br /> He distributed a proposed resolution for the City Council to consider, <br /> enumerating his requests. He said he is not asking the City Council <br /> to change the Ordinance but is asking for the opportunity to present <br /> a report, at his option, using the standards of the Uniform Code for <br /> Building Conservation. He introduced his engineer, Ron Hamburger, of <br /> EQE. <br />
