Minutes - San Leandro City Council Meeting - September 16, 1991 Page - 7 - <br /> NEW BUSINESS (continued) <br /> He said the second action the Council was requested to take was a motion <br /> that would permit the City Manager to enter into agreements with <br /> subcontractors for design of such aspects of the project as <br /> architectural engineering, soils, heating and ventilating systems, etc. <br /> He said the work done by the subcontractors would be based upon <br /> recommendations by Pacific Union, but the agreements would be entered <br /> into by the City. He went on to describe the five phases of the scope <br /> of work for the Civic Center Renovation Project and the costs for the <br /> developer and other subcontractors' costs. The project consists of: <br /> Phase I, preparation of schematic plans for presentation for developers' <br /> proposal purposes. He said Phase I would be entered into as a result <br /> of tonight's action. He said after Phase I the City Council would then <br /> determine if it wished to proceed into Phase II, the entitlement <br /> process. He said each of the additional phases would be brought back <br /> to the City Council for approval . Those phases included Phase III, <br /> preparation of the construction documents for the expansion phase, call <br /> for bids; Phase IV, construction of expansion project; and Phase V, <br /> building retrofit program. He said the total cost of the project is <br /> within the parameters described in the City budget. <br /> Council Member Perry asked if, by approving the contract with all five <br /> phases, the City would be committing to all five phases. She asked if <br /> it would be preferable to have five separate contracts. She also asked <br /> if the review of each phase would be by the full City Council or by the <br /> City Council subcommittee. <br /> Steve Meyers, City Attorney said the approval of the Agreement does not <br /> commit the City to proceed with the elements in the Agreement. He said <br /> the City has the right to terminate this Agreement and to limit its <br /> costs. <br /> Mr. Oliver said the Civic Center Master Plan Committee has been <br /> reviewing the project development prior to full City Council review all <br /> along, and it would be anticipated that procedure would continue to be <br /> used. He said the process to date has been for the Committee to provide <br /> feedback to the consultant and for the consultant to incorporate that <br /> feedback into a presentation to the full City Council . <br /> Mr. Meyers pointed out that page 2 of Exhibit B allows the City to <br /> terminate the services to be provided under the Agreement without cause <br /> at any point in time at the sole and exclusive discretion of the City, <br /> and, in that event, the City would compensate the contractor for all <br /> outstanding costs incurred as of the date of termination of the <br /> Agreement. <br />
