Minutes - San Leandro City Council Meeting - November 4, 1991 Page - 6 - <br /> NEW BUSINESS (continued) <br /> The following Motion was then introduced: <br /> MINUTE ORDER NO. 91-100 (1203) <br /> APPROVAL OF FINANCE DIRECTOR'S REPORT ON <br /> CALCULATION OF BUSINESS LICENSE FEE ADJUSTMENTS <br /> EFFECTIVE JANUARY 1, 1992 <br /> AS SPECIFIED BY ORDINANCE NO. 90-020 <br /> On motion by Council Member Faria who moved its approval , seconded by Council <br /> Member Santos and carried by the following called vote, the City Council approved <br /> the Finance Director's Report on the calculation of Business License Fee <br /> Adjustments, effective January 1 , 1992, as specified by Ordinance No. 90-020. <br /> AYES: Council Members Corbett, Faria, Glaze, Perry, Polvorosa, Santos; <br /> Mayor Karp ( 7 ) <br /> NOES: None ( 0 ) <br /> ABSENT: None ( 0 ) <br /> 8. PUBLIC HEARINGS <br /> A. Matter of Appeal by Aderito Santos Vales of the Board of Zoning <br /> Adjustments' Denial of V-91-4; Variance to Construct an Addition to <br /> Existing Duplex Which Would Reduce the Required Rear-Yard Setback from <br /> 15 Feet to 5 Feet; 1427 Orchard Avenue; Assessor's Parcel Number <br /> 75-115-25; Aderito Santos Vales; R-2 (Two-Family Residence) District. <br /> This being the time and place for the Public Hearing on the above <br /> matter, Elmer Penaranda, Assistant Planner, described the location of <br /> the subject property and the surrounding area. He said the Applicant, <br /> Mr. Vales, had built an addition on the rear of the property without <br /> submitting plans or obtaining permits. He said Mr. Vales was told to <br /> submit plans after it was determined that the addition had been built. <br /> He said the plan review revealed the addition encroached into the <br /> required, rear-yard setback by ten feet, leaving only a five-foot <br /> setback. He said Mr. Vales was told he could either correct the <br /> condition or apply for a Variance, and he had applied for a Variance. <br /> Mr. Penaranda said the addition is a room with a half bath and a closet <br /> for one of the duplex units. He showed slides of the addition, <br /> including the five-foot separation between the addition and the rear <br /> fence, the side-yard areas, and the sun deck that has been built on top <br /> of the addition. <br /> Council Members Perry and Glaze asked questions regarding where the old <br /> addition, which apparently had been built with Permits, ended and the <br /> new addition began. They asked if the previous addition was legally <br /> built. <br />
