Minutes - San Leandro City Council Meeting - February 5, 1990 Page - 7 - <br /> PUBLIC HEARINGS (continued) : <br /> David Jorgensen, 698 Dutton Avenue, owner of the Mission Bell Apartments, <br /> spoke at length. He said the Ordinance is without appeal . He and his sons, <br /> Jeff and Brad, handed out photographs of their property and a number of other <br /> documents related to rent schedules, painting plan, etc. They also presented <br /> a signed petition. He said the Ordinance placed a heavy financial burden <br /> on property owners. He felt the City Council should allow property owners <br /> to deal with their properties on a voluntary basis and felt the City Council <br /> had moved too quickly in this matter. <br /> Jeff Jorgensen, 694 Dutton Avenue, asked the Friends of Mission Bell to <br /> present a petition to the City Council . The Jorgensens again said they felt <br /> gradual , voluntary upgrading of properties should be permitted. <br /> The City Council noted the damage that had been caused in other cities in <br /> the October earthquake. They asked a number of questions related to the <br /> possibility for financing. <br /> Don Lee, President of Delmar Business Association, also an owner of one of <br /> the unreinforced masonry properties, said he felt the City was moving too <br /> fast and should slow down and review other options. <br /> Nancy Vinners, owner of Nicky Travel , spoke on behalf of her mother, the <br /> owner of 555 East 14th Street. She said that, although their building is <br /> not one of the buildings involved, 28 of the buildings are in the North Area <br /> and she felt the program should not be mandatory. She said the program <br /> should be voluntary at first and then mandatory if needed. <br /> Tom Silva, 3979 Monterey Boulevard, spoke for his parents, Rick and Florence <br /> Silva, the owners of 6888 East 14th Street, and asked a number of questions <br /> related to formulas in the Ordinance and asked that they be explained in <br /> layman's terms. He also said the requirements of the Ordinance were a heavy <br /> financial burden and urged the City Council to look at a way to help property <br /> owners. <br /> Gordon Green, noted that asbestos could become a problem in retrofitting some <br /> of the buildings and said there was a liability for everyone now that these <br /> buildings had been identified. He recommended that the City look at a longer <br /> time line and try to find funding from County, State or Federal sources. <br /> There being no further comments from the public, on motion of Council Member <br /> Santos, seconded by Council Member Suchman and carried unanimously, the <br /> Public Hearing was closed. <br /> The City Council had considerable discussion related to the average cost for <br /> the engineering analysis, possible methods of funding, the balance of public <br /> health and safety vs financial impact on the property owners. The City <br /> Council also discussed the property owners' right to appeal any of the <br /> provisions of the Ordinance. It was noted that appeal was possible to the <br /> Board of Appeals. <br />
