Minutes - San Leandro City Council Meeting - May 7, 1990 Page - 5 - <br /> PUBLIC HEARINGS: <br /> a. Matter of FM-89-15; Fence Modification; to Maintain an Existing 4-Foot-High, <br /> Wrought-Iron Fence with Brick Pilasters in the Required Front and Street- <br /> Side Yards of a Corner Lot; 2390 Jamaica Way (Southeast Corner of Jamaica <br /> Way and Tahiti Road) ; Assessor's Parcel Number 80G-927-6; Jose Soares (Owner) <br /> and Manuel Faria (Attorney) ; R-1 (Single Family) Residence District -- <br /> Appeal . <br /> This being the time and place for the Public Hearing on the above matter, <br /> Gaye Quinn, Acting City Planner, indicated that Mr. Soares was appealing the <br /> Board of Zoning Adjustments' Conditions of Approval for his fence <br /> modification application at 2390 Jamaica Way. She also indicated that the <br /> City became aware of the violation through a complaint to the Community <br /> Standards Section that the fence exceeded the three-foot height limitation. <br /> Mayor Karp and Council Member Santos indicated that they had also received <br /> complaints about the height of the fence. <br /> During discussion about the parking of a recreational vehicle in the <br /> sideyard, Council Member Santos asked if it was legal to pave a street-side <br /> sideyard. City Planner Martin Vitz responded that, although it was not <br /> illegal to pave a sideyard, a vehicle may not be legally parked on the front <br /> setback. <br /> Mayor Karp noted that the gate in front of the driveway opened into the <br /> sidewalk and he thought that the gates could not open into the property when <br /> cars were parked in the driveway. <br /> Gaye Quinn indicated that there was testimony at the Board of Zoning <br /> Adjustments Hearing that the spikes that topped the fence were hazardous to <br /> pedestrians. <br /> The Hearing was then opened to the public. <br /> Manuel Faria, 2205 West Winton Avenue, Hayward, the Appellant's attorney, <br /> indicated that there was only one couple who appeared at the Board of Zoning <br /> Adjustments Hearing and not a group of residents, as had been earlier <br /> implied. <br /> Council Member Santos asked what Mr. Soares did for a living and where he <br /> conducted his business. Mr. Faria indicated Mr. Soares is a gardener doing <br /> business from his home. <br /> Council Member Santos asked how long Mr. Soares had been running his business <br /> out of his home and whether he had a Home Occupation Permit. Mr. Faria <br /> indicated nine years and that he had no permit other than filing his income <br /> taxes. <br /> Council Member Santos asked Mr. Faria if he used a truck for his business <br /> and if so where he customarily parks it. Mr. Faria indicated that he parks <br /> his truck in front of his home. <br />
