Minutes - San Leandro City Council Meeting - September 4, 1990 Page - 9 - <br /> MISCELLANEOUS <br /> a. Matter of Utility User Tax (implements Utility Users' Tax Study Committee <br /> recommendations to change commercial tax rate to 6% on first $300,000 of <br /> energy use and 2% thereafter) . <br /> John Jermanis, Finance Director, referred to the Ordinance on the Agenda. <br /> He said this Ordinance completes the process started in June with the <br /> adoption of the City budget. He said the City budget recommended the removal <br /> of the current $10,000 cap on the utility tax. He said the City Council <br /> appointed a committee to review the existing tax and make recommendations <br /> for alternatives to removal of the cap. He said the Utility User Tax Study <br /> Committee had recommended the establishment of a tax rate for non-residential <br /> users of 6% on the first $300,000 of combined energy and telephone use and <br /> 2% thereafter. He said this would raise approximately $1 .2 million in <br /> revenue. <br /> The City Council asked for a breakdown of revenue collected, based both on <br /> the 6% and the 2% tax. They also asked questions related to the method for <br /> rebate for overpayments and the possible impact and type of outreach that <br /> was conducted with small businesses regarding the 1% increase from 5% to 6%. <br /> Marylou Eckersley, San Leandro Chamber of Commerce, said the Chamber had only <br /> worked with the 19 large businesses involved. <br /> The following Ordinance was then introduced: <br /> ORDINANCE NO. 90-016 (1170) <br /> AN ORDINANCE REPEALING ORDINANCE NO. 90-011 <br /> AND AMENDING TITLE II , CHAPTER 4 <br /> OF THE SAN LEANDRO MUNICIPAL CODE <br /> RELATING TO UTILITY USER TAXES <br /> URGENCY ORDINANCE TO TAKE EFFECT IMMEDIATELY <br /> Introduced by Council Member Glaze, who moved that it be passed to print, <br /> seconded by Council Member Santos, and carried by the following called vote: <br /> AYES: Council Members Corbett, Glaze, Perry, Polvorosa, Santos; <br /> Mayor Karp ( 6 ) <br /> NOES: Council Member Faria ( 1 ) <br /> ABSENT: None ( 0 ) <br /> b. Matter of Amendments to Burglar Alarm Ordinance. On motion of Council Member <br /> Glaze, seconded by council Member Polvorosa and carried unanimously, the City <br /> Council approved the proposed amendments to the Burglar Alarm Ordinance. <br /> c. Appointment of Paul S. Nahm as the Chair of the 1991 Cherry Festival <br /> Executive Committee. <br /> Howard Kerr, Vice President of the Cherry Festival Board of Directors, noted <br /> that Janet Mohr had asked for a delay on confirmation of Mr. Nahm's <br /> appointment until some issues were worked out. Council Member Glaze <br /> suggested that the City Council Cherry Festival Committee be reinstated so <br /> that the City Council Committee could give clarification to the Executive <br /> Committee on the purpose and style of the Cherry Festival . <br />
