Matter of Intention to Vacate a Public Right-of-Nay, an Excess Portion of Teagarden Street at Marina Boulevard. This being the time and place for the Public Hearing on the above matter, Rob Caughell , Administrative Assistant, Engineering and Transportation • Department, said this vacation was a follow-up to the property acquisition program for Marina Boulevard. He said Teagarden was realigned with Wayne Avenue and this left an excess parcel on Teagarden. He said the excess • property would be deeded to the owner of the Safeway Preserve Plant as replacement for on-street parking eliminated on Marina Boulevard. The Hearing was then opened to the public. There being no comments from the public, on motion of Council Member Faria, seconded by Council Member Santos and carried unanimously, the Public Hearing was closed. The following Ordinance was then introduced: ORDINANCE NO. 90-021 (1007) AN ORDINANCE VACATING A PORTION OF A PUBLIC STREET KNOWN AS TEAGARDEN STREET Introduced by Council Member Polvorosa, who moved that it be passed to print, seconded by Council Member Faria, and carried by the following called vote: AYES: Council Members Corbett, Faria, Glaze, Polvorosa, Santos; Mayor Karp ( 6 ) NOES: None ( 0 ) ABSENT: Council Member Perry ( 1 ) b. Matter of Annual Review of Development Fees for Street Improvements (DFSI) and Compliance with AB 1600 of DFSI Appropriations. This being the time and place for the Public Hearing on the above matter, Roy Parker, Acting Director, Engineering and Transportation Department, said the purpose of the Public Hearing was to request approval from the City Council of the 1990-91 DFSI Capital Improvement Program 5-year program through 1994-95. He said the Municipal Code requires an Annual Review of the condition of the DFSI fund. He said the DFSI was approved as part of the Master Plan of City Streets and that the current charge is $1 ,000 per p.m. peak-hour trip. He said the DFSI is overcommitted by approximately $591 ,000. The City Council asked questions regarding the list of intersections in the Capital Improvement Program and asked if staff would come back to the City Council for approval to construct these improvements. Staff responded that • the City Council always had the option to make changes to the program.
