1. Instituting and completing proceed- <br />ings to open, close, vacate, widen, or change <br />the grade of streets, alleys, and public rights- <br />of-way, and for other necessary modifica- <br />tions of the streets, the street layout, and <br />other public rights-of-way in the project ar- <br />ea. The city may require the abandonment, <br />removal, and relocation by public utility <br />companies of their operations in public <br />rights-of-way as appropriate to carry out the <br />plan, provided that nothing in the plan shall <br />be construed to require the cost of such <br />abandonment, removal, and relocation be <br />borne by others than those legally required <br />to bear such costs. <br />2. Instituting and completing proceed- <br />ings necessary for changes and improve- <br />ments in private and publicly -owned public <br />utilities within or affecting the project area. <br />3. Revising the zoning code or adopting <br />specific plans as appropriate within the pro- <br />ject area to permit the land uses and devel- <br />opment authorized by the plan. <br />4. Imposing wherever necessary (by <br />covenants or restrictions, conditional use <br />permits or other means) appropriate controls <br />within the limits of the plan upon parcels in <br />the project area to ensure their proper devel- <br />opment and use. <br />5. Executing statutory development <br />agreements where necessary and appropriate <br />to facilitate developments approved by the <br />agency. <br />6. Providing for administrative en- <br />forcement of the plan by the city after de- <br />velopment. <br />7. Performing the above actions, and all <br />other functions and services relating to pub- <br />lic health, safety, and physical development <br />normally rendered in accordance with a <br />schedule which will permit the redevelop- <br />ment of the project area to be commenced <br />KXIMIX11 <br />and carried to completion without unneces- <br />sary delays. <br />8. Providing services and facilities and <br />the various officials, offices and departments <br />of the city for the agency's purposes under <br />the plan. <br />9. Providing financial assistance. <br />10. Undertaking and completing any <br />other proceedings necessary to carry out the <br />project. <br />B. The foregoing does not constitute a <br />commitment by the city to make any outlays <br />of funds, although it may elect to do so. <br />(Ord. 99-025 § 500, 1999) <br />3.08.090 Enforcement. <br />The administration and enforcement of <br />the plan, including the preparation and exe- <br />cution of any documents implementing the <br />plan, shall be by the agency and/or the city, <br />as appropriate. <br />The provisions of the plan or other <br />agreements entered into pursuant to the plan <br />may be enforced by court action instituted <br />by either the agency or the city. The agency <br />or the city may pursue any and all remedies <br />available to it, including specific perfor- <br />mance, damages, reentry, injunctions, or any <br />other remedies appropriate to the purposes <br />of the plan. In addition, the owners of prop- <br />erty in the project area may seek enforce- <br />ment of any recorded provisions that are <br />expressly for their benefit. (Ord. 99-025 § <br />600, 1999) <br />3.08.100 Duration of the plan. <br />The plan shall remain effective for a pe- <br />riod of thirty-one (3 1) years from the date of <br />adoption of the plan. After the time limit on <br />the effectiveness of the plan, the agency <br />shall have no authority to act pursuant to the <br />plan except to pay previously incurred in - <br />125 (San Leandro Redevelopment Agency Supp. No. 3, 7-10) <br />
