3.08.110 <br />debtedness and to enforce existing cove- <br />nants or contracts. Provided that, if the <br />agency has not completed its replacement <br />housing obligations pursuant to Health and <br />Safety Code Section 33413, the agency shall <br />retain its authority to implement require- <br />ments under Section 33413, including its <br />ability to incur and pay indebtedness for this <br />purpose, and shall use this authority to com- <br />plete these housing obligations as soon as is <br />reasonably possible. (Ord. 2003-020 § 1 <br />(part), 2003; Ord. 99-025 § 700, 1999) <br />3.08.110 Procedure for amending the <br />plan. <br />The plan may be amended as provided in <br />the Community Redevelopment Law encod- <br />ed as Health and Safety Code Section <br />33000, et seq. (Ord. 99-025 § 800, 1999) <br />3.08.120 Severability. <br />If any portion of the plan is held to be <br />invalid, unenforceable, or unconstitutional, <br />such decision shall not affect the validity <br />and effectiveness of the remaining portion or <br />portions of the plan. If any portion of the <br />project area shall be determined to have <br />been invalidly or incorrectly included in the <br />project area, such portion of the project area <br />shall be deemed severed from the remainder <br />of the project area, which shall remain fully <br />subject to the plan. Mandated Action—Ordinance 2007- <br />015, June 18, 2007: <br />Pursuant to SB 53, which added Health <br />and Safety Code Section 33342.7, the City <br />Council, as the legislative body, was re- <br />quired to adopt an ordinance describing the <br />redevelopment agency's program to acquire <br />(San Leandro Redevelopment Agency Supp. No. 3, 7-10) 126 <br />real property by eminent domain for any <br />final redevelopment plan adopted prior to <br />January 1, 2007. The City Council complied <br />with this mandate by adopting Ordinance <br />2007-015 on June 18, 2007 for the West San <br />Leandro/MacArthur Boulevard Project Area. <br />2. Mandated Action—Revised State- <br />ment of Institution of Redevelopment Pro- <br />ceedings: <br />Pursuant to SB 1809, which amended <br />Health and Safety Code Section 33373, the <br />Redevelopment Agency recorded a Revised <br />Statement of Institution for the West San <br />Leandro/MacArthur Boulevard Project Area <br />on August 22, 2007, Instrument <br />#2007308839, which included a description <br />of the boundaries of the project area and <br />information relating to eminent domain au- <br />thority as described in the redevelopment <br />plan and as required by law. <br />
