3.16.010 <br />Whenever a business will be displaced <br />from property within the project area by re- <br />development activities, the agency will de- <br />termine whether the business wishes to relo- <br />cate directly to an already redeveloped prop- <br />erty within the project area or would rather <br />reenter the project area at a later time after <br />other property has been redeveloped. <br />If the business wishes to relocate directly <br />to an already redeveloped property within <br />the project area, the agency will use its relo- <br />cation assistance program to provide the <br />necessary aid. However, the business must <br />meet the criteria established in the agency's <br />rules in order to be referred to a particular <br />redeveloped property. Those criteria include <br />the business' compatibility with the uses <br />planned for the property and the desired <br />character of the redevelopment, and the <br />business' ability to pay the lease rate or pur- <br />chase price. <br />If the business prefers to wait and reenter <br />the project area after other property has been <br />redeveloped, the agency will keep the busi- <br />ness information on file and will contact the <br />business when such property becomes avail- <br />able. The business will not be eligible for <br />the agency's relocation assistance program <br />to aid its move back into the project area. <br />However, the business will be extended a <br />preference for reentry in the form of agency <br />notification when appropriate redeveloped <br />sites become available. (Ord. 99-025 § <br />204.4, 1999) <br />Chapter 3.16 <br />RELOCATION OF PERSONS AND <br />BUSINESSES DISPLACED BY THE <br />PROJECT <br />Sections: <br />(San Leandro Redevelopment Agency Supp. No. 2, 12-05) 128 <br />3.16.010 <br />General. <br />3.16.020 <br />Relocation plan. <br />3.16.030 <br />Assistance in finding <br />other locations. <br />3.16.040 <br />Displaced persons of low <br />and moderate income. <br />3.16.050 <br />Relocation payments. <br />3.16.010 General. <br />The agency shall establish relocation <br />rules to guide assistance and payments to by <br />project persons and businesses displaced <br />activities. The rules shall comply with the <br />requirements of the relocation assistance and <br />real property acquisition guidelines adopted <br />by the California Department of Housing <br />and Community Development (Cal. Code <br />Regs., title 25, Section 6000 et seq.) (the <br />"state guidelines"). Such rules shall include <br />a feasible method for relocating persons to <br />be displaced from housing in the project ar- <br />ea. The agency may use funds derived from <br />any public or private source to carry out the <br />purposes of this chapter. <br />The agency shall establish a grievance <br />procedure for persons or businesses that are <br />dissatisfied with the relocation assistance or <br />payments provided. (Ord. 99-025 § 208.1, <br />1999) <br />3.16.020 Relocation plan. <br />Before proceeding with any activity that <br />will displace more than fifteen (15) residents <br />or five businesses, the agency shall prepare a <br />relocation plan and submit it to the city <br />council for approval. The relocation plan <br />shall include the information required in <br />Section 6038 of the state guidelines and <br />shall be consistent with the housing element <br />of the city's general plan. The agency shall <br />provide public notice of the relocation plan <br />
