and make copies of such plan available upon <br />request. (Ord. 99-025 § 208.2, 1999) <br />3.16.030 Assistance in finding other <br />locations. <br />The agency shall provide assistance to <br />persons and businesses displaced by project <br />area activities in locating suitable replace- <br />ment property. The assistance to be provided <br />is described in the agency's relocation rules, <br />which shall be made available to individuals <br />and businesses at least ninety (90) days be- <br />fore they are scheduled to be displaced. If <br />there is any conflict between the agency's <br />rules and the state guidelines, the state <br />guidelines shall control. <br />No eligible person shall be required to <br />move from his or her dwelling unless within <br />a reasonable period of time prior to dis- <br />placement comparable replacement dwell- <br />ings or, in the case of a temporary move, <br />adequate replacement dwellings are availa- <br />ble to such person. Such replacement dwell- <br />ings shall be made available in the city of <br />San Leandro if the eligible person requests. <br />The agency shall notify any eligible person <br />of this requirement in writing. (Ord. 99-025 <br />§ 208.3, 1999) <br />3.16.040 Displaced persons of low <br />and moderate income. <br />The agency's method or plan for reloca- <br />tion shall provide that no persons or families <br />of low and moderate income shall be dis- <br />placed unless and until there is a suitable <br />housing unit available and ready for occu- <br />pancy at rents comparable to those at the <br />time of their displacement. Such housing <br />units shall be suitable to the needs of such <br />displaced persons or families and must be <br />decent, safe, sanitary, and otherwise stand- <br />ard dwellings. The agency shall not displace <br />such person or family until such housing <br />units are available and ready for occupancy. <br />If suitable housing units are not available <br />in the city for low- and moderate -income <br />persons and families who will be displaced <br />from the Project Area, the city council shall <br />assure that sufficient land is made available <br />for such housing. The agency may direct or <br />cause the development, rehabilitation or <br />construction of such housing within the city, <br />both inside and outside of the project area, <br />as needed to correct the deficiency in hous- <br />ing for displaced low- and moderate -income <br />persons and families. <br />Whenever all or any portion of the pro- <br />ject area is developed with low- or moder- <br />ate -income housing units, the agency shall <br />require by contract or other appropriate <br />means that such housing be made available <br />for rent or purchase to the persons and fami- <br />lies of low or moderate income displaced by <br />the project. Such persons and families shall <br />be given priority in renting or buying such <br />housing. (Ord. 99-025 § 208.4, 1999) <br />3.16.050 Relocation payments. <br />The agency shall make fair and reasona- <br />ble relocation payments as prescribed by the <br />state guidelines and the agency's relocation <br />rules and regulations. If there is any conflict <br />between the agency's rules and regulations <br />and the state guidelines, the state guidelines <br />shall control. The agency may exceed the <br />maximum payments established in the state <br />guidelines in accordance with agency policy <br />establishing the requirements and conditions <br />for providing excess payments.
