3.20.010 <br />Chapter 3.20 <br />PUBLIC IMPROVEMENTS AND SITE <br />PREPARATION <br />Sections: <br />3.20.010 <br />Demolition and clearance. <br />3.20.020 <br />Removal of graffiti. <br />3.20.030 <br />Public improvements. <br />3.20.040 <br />Financing of facilities or <br />capital equipment. <br />3.20.050 <br />Preparation of building <br />sites. <br />3.20.060 <br />Hazardous waste. <br />3.20.010 Demolition and clearance. <br />The agency is authorized to demolish and <br />clear or move buildings, structures, and oth- <br />er improvements from any real property in <br />the project area as it determines necessary or <br />convenient to carry out the purposes of the <br />plan. (Ord. 99-025 § 209.1, 1999) <br />3.20.020 Removal of graffiti. <br />The agency may take any actions within <br />the project area that the agency determines <br />are necessary to remove graffiti from public <br />or private property upon making a finding <br />that, because of the magnitude and severity <br />of the graffiti within the project area the ac- <br />tion is necessary to effectuate the purposes <br />of the plan and that the action will assist <br />with the elimination of blight. (Ord. 99-025 <br />§ 209.2, 1999) <br />3.20.030 Public improvements. <br />A. Subject to the requirements of Health <br />and Safety Code Section 33445, the agency <br />is authorized to pay all or a part of the value <br />of the land for and the cost of the installation <br />and construction of any building, facility, <br />(San Leandro Redevelopment Agency Supp. No. 2, 12-05) 130 <br />structure, or other improvement which is <br />publicly owned either within or without the <br />project area. Such payments are subject to <br />the city council's finding all of the follow- <br />ing: <br />1. That the buildings, facilities, struc- <br />tures, or other improvements are of benefit <br />to the project area or the immediate neigh- <br />borhood in which the public improvement is <br />located; <br />2. That no other reasonable means of <br />financing the buildings, facilities, structures, <br />or other improvements are available to the <br />city; and <br />3. That the payment of funds for the <br />acquisition of land or the cost of buildings, <br />facilities, structures, or other improvements <br />will assist in the elimination of one or more <br />blighting conditions inside the project area <br />or provide housing for low- or moderate - <br />income persons, and is consistent with the <br />implementation plan for the project. <br />B. Such determinations by the agency <br />and the city council shall be final and con- <br />clusive. The agency may pay all or part of <br />the value of the land for and the cost of the <br />installation and construction of any building, <br />facility, structure or other improvement set <br />forth in Appendix C to the plan, "proposed <br />public improvements and facilities projects." <br />C. When the value of the land or the <br />cost of the installation and construction of <br />the public improvement has been or will be <br />paid or provided for initially by the city or <br />other public corporation, the agency may <br />enter into a contract with the city or other <br />public corporation under which it agrees to <br />reimburse the city or other public corpora- <br />tion for all or part of the value of the land or <br />all or part of the cost of the building, facili- <br />ty, structure, or other improvement, or both, <br />by periodic payments over a period of years. <br />
